Exploring the Causes of Inadequacy of Traffic Laws and Regulations Regarding the Prevention of Crimes and Violations of Motorcycle Riders in Mashhad

نظم اجتماعي در هر جامعه اي از اهميت بالايي برخوردار است، زيرا دوام و بقاي هر جامعه به حفظ نظم اجتماعي آن جامعه بستگي دارد و نظم اجتماعي با قانون ميسر مي‌شود. در هر جامعه‌اي، قوانين اجتماعي مبناي رفتار افراد در زندگي اجتماعي است. در حقيقت، اين قوانين هستند كه مرزهاي مجاز رفتار افراد را تعريف و تعيين، و از اين رهگذر، نظم اجتماعي را ممكن مي كنند. با ناديده گرفتن و زير پا گذاشتن قوانيني كه از طريق مجاري رسمي به تصويب مي رسد، موجب قانون‌گريزي در جامعه مي‌شود. تخلفات و عدم رعايت قوانين حوزه راهنمايي و رانندگي به‌ خصوص تخلفات مربوطه به موتور سيكلت‌ها از جلمه شايع‌ترين تخلفات رانندگي است. موتور سيكلت به دليل كم حجم بودن، قدرت مانور بالا، ارزان بودن، طالبان فراواني داشته و روز به روز بر تعداد آنها افزوده مي شود و در كنار افزايش اين وسيله نقليه، ميزان تخلفات آنها به مراتب در حال افزايش است. روش تحقيق در مقاله حاضر از نوع پيمايشي ـ ميداني است. نتايح نشان مي‌دهد كه نحوه برخورد پليس، در اجراي قوانين و مقررات راهنمايي و رانندگي، تاثير بسزائي در پيشگيري و كاهش جرائم و تخلفات موتورسيكلت سواران خواهد داشت. لذا ضروري است، نيروي انتظامي برنامه ريزي هدفمند و كاربردي جهت آموزش پرسنل مربوطه در جهت ارتقاي آموزش قوانين و مقررات راهنمايي و رانندگي و نيز نحوه اجرا و برخورد با موتورسيكلت سواران متخلف داشته باشد. همچنين قانونگذار قوانين و مقررات راهنمايي و رانندگي را به طور مستمر به روز كند تا بتواند به هدف پيشگيري و كاهش جرائم و تخلفات موتورسيكلت سواران برسد.

The social order in every society is of great importance, because the survival of each society depends on maintaining its social order and social order is possible with the law. In every society, social laws are the basis of the behaviors of individuals in social life. In fact, these are the rules that define the boundaries of the individual's behavior, and, in this way, make social order possible. By ignoring and breaking the rules passed through the official channels, it will lead to legislation in the society. Violations and disregard of traffic laws, especially motorcycle offenses, are among the most common violations of driving. The motorcycle attracts a lot of people because of its compact size, high maneuverability, cheapness, and increasing number of vehicles. Along with the increase in this vehicle, their violations are increasing. The research method in this paper is a field survey type. The results show how the police deal with enforcement of traffic laws and regulations will have a significant impact on the prevention and reduction of crimes and offenses committed by motorcyclists. Therefore, it is necessary for the law enforcement force to plan targeted and applied training for the personnel concerned in order to improve the education of traffic regulations and how to handle and deal with riders who disobey the law. The legislator also continually updates traffic laws and regulations so that they can achieve the objective of preventing and reducing crimes and offenses committed by motorcycle riders.
