بررسي تأثير قانون گرايي بر ميزان پيشگيري و كاهش جرائم و تثبيت نظم و امنيت در جامعه

قانون گرايي در مجامع و نوشته هاي علمي به عنوان مفهومي بكار مي رود كه به اصالت قانون و اصول قضايي و حقوقي در روابط بين مردم و و دولت و همچنين روابط مابين خود مردم معتقد مي باشد. بر طبق اين عقيده در عرصه سياست جهاني رفتار بين المللي ملاك عملكرد دول، شرايط اخلاقي و اجتماعي نيست بلكه روابط حقوقي و شرايط تابعه آن معيار است. اكثر قانونگرايان بر اين عقيده اند كه دولت محصول قانون است و در مورد دولت، جامعه و كشور بايد تنها صلاحيت حقوقي، قانوني و قضايي را در نظر بياورد، هرچند با اخلاق و مذهب متغاير و متضاد باشد. از سوي ديگر يكي از معضلات مهم جامعه ي امروز، فرار از قانون در هر زمينه اي مشكلات زيادي را براي جامعه ايجاد كرده است. همزمان با گسترش انقلاب صنعتي و وسعت دامنه نيازمندي ها، محروميت هاي حاصل از عدم امكان تامين خواست ها و احتياجات زندگي موجب توسعه شديد و دامنه دار فساد، عصيان، تبهكاري، دزدي و بعنوان كلي جرم و جنايت شده است. به لحاظ حقوقي و قانوني جرم به هر فعل و يا ترك فعلي كه در قانون براي آن مجازاتي تعيين كرده باشد تلقي مي گردد. وجود رابطه معنا دار بين التزام به قانون و پيشگيري از جرم و كاهش جرائم و به تبع آن بالا رفتن ميزان نظم و امنيت يك جامعه موضوعي است كه در پژوهش حاضر مورد توجه قرار گرفته است.
