سياست كيفري جمهوري اسلامي ايران پيرامون قاچاق كالا و علل و تأثيرات اين جرم از منظر امنيت اقتصادي، اجتماعي و فرهنگي

Criminal Policy of the Islamic Republic of Iran on the smuggling of goods and the causes and effects of this crime in terms of economic, social and cultural security

توسعه و شكوفايي كشور در پرتو امنيت و ثبات اقتصادي رقم مي‌خورد. ازاين‌رو مسئولين و نهادهاي ذي‌ربط، قوانين و هنجارهاي مختلفي را براي نيل بدين مقصود وضع نموده‌اند. در اين ميان پديده قاچاق و به‌ويژه قاچاق كالا، آثار و پيامدهاي مخرّب و زيان‌باري به‌خصوص در رابطه با امنيت اقتصادي به همراه خواهد داشت. قاچاق كالا ضمن برهم زدن امنيت اجتماعي، اقتصاد جامعه را نيز با اختلال مواجه نموده و مسير هموار رشد و پويايي كشور را با مانع روبه‌رو مي‌سازد. ازاين‌رو نظام عدالت كيفري به‌عنوان حافظ و نگهبان منافع جامعه به مبارزه با اين پديده شوم برخاسته است؛ امّا تدوين نظام كيفري عدالت محور و مبارزه همه‌جانبه با اين پديده، نيازمند شناخت علل، آثار و پيامدهاي آن به‌ويژه در رابطه با امنيت اقتصادي جامعه مي‌باشد. قاچاق كالا تأثيرات عمده‌اي بر امنيت اقتصادي، اجتماعي و فرهنگي كشور دارد كه آثار و پيامدهاي ناشي از اين امر، ضرورت اتّخاذ تمهيدات مناسب و كارآمد براي مقابله با اين ناهنجاري را بيش‌ازپيش گوشزد مي‌نمايد. در اين نوشتار كوشش شده تا ضمن بررسي نظام عدالت كيفري كشورمان پيرامون مبارزه با قاچاق كالا، علل اين پديده و تأثيرات آن را بر جامعه و امنيت اقتصادي مورد بررسي، تجزيه‌ و تحليل قرار دهيم.

Development and prosperity of the country is determined in light of security and economic stability. Therefore, authorities and relevant institutions have imposed different laws and norms to achieve this purpose. Meanwhile, trafficking and especially goods trafficking has destructive effects and consequences, especially in relation to economic security. Goods trafficking not only disturbs public security, but also it disturbs the economy of the society and blocks the well-worn path of growth and dynamism of the country. Therefore, the criminal justice system as a safeguard for the interests of society has started fighting against this ominous phenomenon; but developing a justice-based system of criminal justice and comprehensive fight against this phenomenon requires an understanding of its causes, effects and consequences particularly in relation to the economic security of society. Goods trafficking has significant effects on economic, social and cultural security of the country. Its effects and consequences address further the need to adopt appropriate and effective measures to fight against this abnormality. In this paper, it is attempted to investigate the criminal justice system in our country. Also, the causes of this phenomenon and its effects on society and economic security will be analyzed.
