بازرسي يا تفتيش از جمله اختياراتي است كه در راستاي كشف جرم و گردآوري ادله به مأموران پليس داده شده است. بازرسي مي تواند به صورت بازرسي بدني، منزل و وسايل نقليه انجام شود. به منظور جلوگيري از هرگونه سوءاستفاده احتمالي در نقض حقوق شهروندان، بايد موازيني در زمينه محدوده اختيارات پليس در زمان بازرسي پيش بيني شود. بنابراين هدف اصلي تحقيق بررسي حقوق اشخاص در بازرسي منزل و وسائط نقليه در آيين دادرسي كيفري 1392 مي‌باشد كه به روشِ توصيفي - تحليلي تهيه گرديده و سوال اصلي در اين پژوهش پيرامون اين مسئله بحث مي‌كند كه: «حقوق اشخاص در بازرسي منزل و وسائط نقليه در آيين دادرسي كيفري مصوب سال 1392 بر اساس چه معيارهايي است ؟». بازرسي در زمان هاي خاص، براساس قانون و بنا به تشخيص و دستور مقام قضايي، توسط ضابطين داراي صلاحيت؛ از جمله پليس ؛ صورت مي‌پذيرد. رعايت تشريفات و موازين قانوني و اجتناب از هرگونه بكارگيري زور و اجبار در زمان انجام بازرسي، از مهم ترين معيارهايي هستند كه در راستاي پيشگيري از نقض احتمالي حقوق و آزادي هاي شهروندان پيش بيني شده است. با توجه به اينكه بازرسي و تفتيش به عنوان يك موضوع حقوقي، ارتباط تنگاتنگي با حقوق شهروندان يك جامعه دارد، لذا ميزان آگاهي مسئولان بازرسي و تفتيش نسبت به قوانين و مقررات پراكنده و همچنين ميزان آگاهي شهروندان نسبت به حقوق شهروندي، در اين باره مي‌تواند از اهميت بسزايي برخوردار باشد. در اين راستا، بايد وظايف و اختيارات مقامات صلاحيت‌دار شفاف سازي گردد و قوانين و مقررات به نحوي آورده شود كه به دور از هرگونه ابهام و پيچيدگي هاي حقوقي باشد.

Inspection can be carried out in the form of physical examination, home and vehicles. In order to prevent any possible abuse in the violation of citizens' rights, provision should be made in the area of police authority at the time of inspection. Therefore, the main objective of the study is to examine the rights of individuals in the inspection of homes and vehicles in the penal code of 1392, which is descriptive-analytical, and the main question in this study is that: "The rights of individuals in home inspections and what are the criteria for vehicles in the criminal procedure approved in 2013? Inspection at certain times, by law and in accordance with the discretion and order of the judicial authority, is established by competent authorities, including the police. Observance of legal ceremonies and standards and the avoidance of any use of force and coercion at the time of inspection are among the most important criteria that are anticipated to prevent possible violations of citizens' rights and freedoms. Considering that inspection and auditing as a legal subject are closely related to the rights of citizens of a society, the level of awareness of inspection and inspection authorities towards dispersed laws and regulations, as well as the level of citizens' awareness of the rights of citizens, in this regard It can be of great importance. In this regard, the duties and responsibilities of competent authorities should be clarified and the laws and regulations should be brought in a way that is free from any ambiguity and legal complexity.
