چكيده فارسي :
باينري آپشن يك ابزار جديد در بازار مالي مشتقه و فضاي مجازي است. با اين ابزار فرد روند قيمت دارايي پايه را پيش بيني و براي يك دوره كوتاه مشخص به ظاهر آن را خريده يا مي فروشد. اگر پيش بيني درست باشد برنده مي شود؛ اما در صورت اشتباه، كل سرمايه اش را از دست مي دهد. اين پژوهش از نوع كاربردي و در موضوعشناسي، توصيفي و در مسايل فقهي از صنف تحليلي است و به روش كتابخانه اي در جمع آوري اسناد پرداخته و در صدد اثبات ممنوعيت شرعي و قانوني باينري آپشن بر مبناي مشهور فقيهان است. در مقاله ضمن بررسي اجمالي قمار، اثبات شد كه باينري آپشن يا قمار و حرام است و يا مصداق بازي با رهان بوده كه طبق فتواي بيشتر فقيهان حرام است. البته بنا به نظر برخي تنها حرمت وضعي دارد. در هر صورت برنده مالك اموال نمي شود. همچنين باينري آپشن مصداق اكل مال به باطل و لاضرر بوده و شرعا و عقلا حرام است و به دليل خروج ارز و زيان هاي اجتماعي نيز با مصالح ملي متناسب نيست. وبگاههاي باينري آپشن نيز آلت قمار يا در حكم قمارخانه مجازي است. مشاركت در اين وبگاه ها بدون شرط بندي نيز حكم بازي با آلت قمار بدون رهان را داشته و جايز نيست. بر همين اساس هرگونه فعاليت كارگزاري، طراحي و مديريت وبگاه هاي باينري آپشن نيز از باب اعانه بر اثم، حرام و غيرقانوني است.

This research is of applied type and in thematic, descriptive and in jurisprudential issues of the analytical class and has studied the library method in collecting documents and seeks to prove the religious and legal prohibition of binary options based on the famous jurists.
