چكيده فارسي :
مقايسه تروريست با محاربه و افساد في‌الارض از مباحث بسيار مهم در عرصه پژوهش حقوقي و فقهي است كه مطمع انظار فقها و حقوقدان‌ها معاصر نيز قرارگرفته است. جرم افساد في‌الارض نسبت به محاربه داراي عموميت و شمول است و مي‌توان محاربه را از بارزترين مصاديق آن به شمار آورد. تروريسم به معني ايجاد وحشت و نا امني در بين مردم با انگيزه سياسي بوده كه مي‌تواند تا اندازه‌اي در قانون مجازات اسلامي تحت عنوان محاربه قابل بررسي باشد.
پژوهش مقايسه‌اي بين سه عنوان مجرمانه فوق‌الذكر و يافتن نقاط اشتراك و افتراق آن‌ها و نيز عناوين مشابه ديگر مانند بغي، فتك، اغتيال و غدر كه مورد نكوهش متون حقوقي اسلامي است در فهم و تدوين قوانين جزايي و تعيين دقيق مصاديق هر يك راهگشا خواهد بود. با بررسي‌هاي به عمل‌آمده بين دو نهاد فقهي و حقوق عرفي كه إفساد في الأرض زمينه‌ي فقهي و تروريسم زمينه ي حقوقي را دارا است به اين نتيجه رسيديم كه اين دو عنوان كلي و عام داراي وجوه اشتراك و افتراق بسياري مي باشند.
چكيده لاتين :
The comparison of the terrorist with crime moharebeh and corruption on earth is one of the most important issues in the field of jurisprudence that has been considered by contemporary jurisprudents and lawyers as well. Compared with Moharebeh, the crime of corruption on earth is inclusive, and it can be regarded as the most striking examples of Moharebeh. Terrorism means the creation of panic and insecurity among people with political motives that can be partly investigated in the Islamic Penal Code under the title of Moharebeh. In this paper, we will compare the three above-mentioned offences to find the similarities and differences between the crimes. During this process, other similar examples such as assassination, treachery, and treason which are condemned by Islamic legal texts can help us to understand and formulate criminal laws and also determine the instances for every one of them. By studying these two general terms i.e. Corruption on earth and terrorism, we concluded that there are many similarities and differences between these two concepts.
