چكيده فارسي :
دامنه واكنش به پديده پولشويي و تأمين مالي تروريسم و تكثير تسليحات كشتارجمعي داراي ابعاد جهاني است و باتوجه‌به عكس‌العمل‌هاي متفاوت جامعه بين‌المللي كه از طريق سازمان‌هاي منطقه‌اي و جهاني به‌وقوع پيوست، سياست‌هاي حقوقي گروه ويژه زودتر از آنچه كه تصور مي‌رفت، در حوزه حقوق داخلي و بين‌المللي و مراجع بين‌المللي بازتاب يافت. در اين ميان آنچه كه جامعه بين‌المللي نسبت به آن وحدت‌نظر پيدا كرد، اين بود كه نبرد عليه پولشويي و تأمين مالي تروريسم و تكثير تسليحات كشتارجمعي جز از طريق و روش‌هاي نظام‌مند در عرصه بين‌المللي مقدور نيست. گروه ويژه به‌عنوان تجلّي اراده دولت‌ها و بسيج عمومي جامعه جهاني درجهت ريشه‌كن ساختن پديده‌هاي مزبور به‌شمار مي‌رود. نقش و جايگاه گروه ويژه در اين راستا به‌مثابه يك سازمان بين‌المللي، همواره موردبحث و مناقشه در حوزه حقوق بين‌الملل بوده است.
نويسندگان در پي اثبات اين فرضيه‌اند كه گروه ويژه يك سازمان بين‌المللي با قلمرو جهاني است و نقش، جايگاه و توصيه‌هاي آن با حقوق بين‌الملل و حقوق بين‌الملل عرفي مطابقت دارد.
چكيده لاتين :
The range of responses to the phenomenon of money laundering , terrorism financing and the proliferation has a global dimension and given the diverse reactions of the international community through regional and global organizations, the legal policies of the FATF sooner than previously thought were reflected in domestic and international law and international community. In the meantime, the international community has come to the conclusion that the international fight against money laundering, terrorist financing and proliferation of weapons of mass destruction is only possible through systematic means. FATF is the center of expression of the will of governments and the international community to eradicate these phenomena. The role and position of the FATF in this regard as an international organization has always been controversial in the field of international law.
The authors seek to prove this assumption that the FATF is an international organization with a global scope and that its role, position and the recommendations complying with international and customary law.
