انتقال مالكيت و توافق طرفين از مباحث مهم حقوقي است كه بررسي آن به صورت تطبيقي چندان مورد توجه قرار نگرفته است. هدف مقاله حاضر بررسي توافق طرفين قرارداد بيع در تعيين زمان انتقال مالكيت در حقوق ايران، كنوانسيون بيع بين المللي كالا 1980 وين و حقوق اروپايي است. مقاله حاضر توصيفي تحليلي بوده و با استفاده از روش كتابخانه اي به بررسي موضوع مورد اشاره پرداخته است . يافته هاي مقاله بيانگر اين امر است كه كنوانسيون بيع بين المللي كالا 1980 وين نيز موضوع انتقال مالكيت را به قانون ملي احاله كرده است. بايد توجه داشت وظيفه اين كنوانسيون تنظيم مقررات يكنواخت براي بيع بين المللي كالا است. بنابراين تصويب آن مقررات به منظور هماهنگ و يكنواخت كردن حقوق تجارت بين المللي يا يك قانون تجارت مدرن بود. در خصوص امكان توافق در مورد زمان انتقال مالكيت بايد گفت بر اين اساس مي‌توان گفت توافق در تغيير چگونگي انتقال مالكيت به واسطه عقد بيع مخالف دستورات كلي شارع نيست، لذا مورد تأييد شارع و داخل در عموم (اوفو بالعقود) و (المومنون عند الشروطهم) و نافذ و لازم الرعايه خواهد بود. مقررات حقوق اروپايي نيز در مورد انتقال مالكيت توافق طرفين را در خصوص زمان انتقال مالكيت در اولويت قرار داده است و در صورت عدم توافق مقرراتي را براي زمان انتقال مالكيت وضع كرده است. به عنوان نتيجه گيري بايد گفت كه هم در حقوق ايران و هم در مقررات حقوق اروپايي زمان انتقال مالكيت طبق توافق طرفين مي‌تواند تعيين گردد.

Transfer of ownership and agreement between the parties is an important legal issue that has not received much attention in the comparative context. In this dissertation, an attempt is made to examine the agreement of the parties to the contract of sale in determining the time of transfer of ownership in Iranian law, the 1980 Vienna Convention on the International Sale of Goods and European law. The present dissertation is a descriptive-analytical study using the library method. The results of the treatise indicate that the 1980 Vienna Convention on the International Sale of Goods also referred the issue of transfer of ownership to national law. It should be noted that the task of this convention is to regulate uniformity for the international sale of goods. The enactment of those regulations was therefore intended to harmonize international trade law or a modern trade law. Regarding the possibility of agreeing on the time of transfer of ownership, it should be said that the contract of sale has more customary truth than sharia truth, so it is certain that the rules and regulations related to transactions are more signature an‎d in principle has not established a rule or ruling. On this basis, it can be said that the agreement on changing the transfer of ownership through a contract of sale is not contrary to the general instructions.
