بررسي گسترۀ حق مطالبۀ بهاي املاك واقع در طرح‌هاي تعريض پس از رعايت اختياري برهاي اصلاحي توسط مالكان

Analysis of the Scope of the Right to Demand for Real Estate Prices Located at Municipal Development Projects after Optional Implementation of Correctional Edge by the Owners

اجراي طرح‌هاي عمراني شهرداري آنجا كه مستلزم آزادسازي و تملك املاك شهروندان است، گاهي با مقاومت مالكان و عدم تمكين آنها در زمينۀ اجراي طرح‌هاي مذكور روبه‌رو مي‌شود كه سرانجام با الزام مراجع ذي‌صلاح و مداخلۀ مأموران اجرا مي‌شود و با قهر و غلبه پايان مي‌يابد. اما گاهي مالكان به اختيار و با رضا و رغبت نسبت به اجراي طرح و عقب‌نشيني، اقدام مي‌كنند. در اين حالت استحقاق مالك در خصوص مطالبۀ بهاي ملك خود، گاه مورد ترديد و انكار حقوقدانان و محاكم شده است. بررسي رويۀ قضايي نيز نشان مي‌دهد كه اغلب مالكان در اين مسير سرانجام از اثبات حق خود و مطالبۀ بهاي ملك باز مي‌مانند و شهرداري‌ها قسمتي از املاك آنها را به‌رايگان تملك مي‌كنند. پژوهش حاضر عهده‌دار بررسي مباني استدلالي اين دسته از دادگاه‌ها و حقوقدانان است تا با نقد و ارزيابي آنها، بر اثبات حق اين قبيل مالكان استدلال كند.

Implementation of development plans, where requires the possession of the citizens' lands, sometimes encountered property owners resistance and lack of compliance with these plans that ultimately ends with the compulsion of the competent authorities and the intervention of the executed agents with duress. But sometimes owners take action on the implementation of the plan and optional retreat with discretion and willingly. In this case, the right to claim for value by him has sometimes been questioned and denied by lawyers and courts. Judicial review also shows that most of them are deprived of claim for value and proof their rights and the municipalities have taken over part of their property for free. The present study seeks to examine the reasoning grounds of this category of courts and lawyers to argue on proving the right of this category of owners.
