The Concept of International Solidarity and its Impact on the Structure of Modern International Law

تكامل حقوق بين‌الملل موجب گذار از دوران همزيستي و در نتيجه آغاز عصر همكاري ميان واحدهاي دولتي مستقل شد، اما از نيمۀ دوم قرن بيستم به‌تدريج مفهومي جديد در برخي اسناد حقوق بين‌الملل پديدار شد كه به جامعۀ بشري و حقوق بين‌الملل از زاويه‌اي ديگر مي‌نگرد و تمركز خود را بر اولويت ارزش‌ها و منافع مشترك قرار داده است. بررسي قواعد حقوقي و اسناد بين‌المللي نوين نشان‌‌دهندۀ تأثيرپذيري آنها از اصل همبستگي بين‌المللي است، به‌گونه‌اي كه مي‌توان ادعا كرد حقوق بين‌الملل نوين در حال عبور از مرحلۀ دولت‌محوري و پا نهادن به عرصة ديگري است كه ناظر بر جامعۀ بين‌المللي در كلِ آن است. تحديد پيش‌روندۀ حاكميت‌ دولت‌ها به نفع مصالح جامعۀ بشري تحت تأثير اصل همبستگي در نهايت مي‌تواند موجبات تحول ساختاري در نظام حقوقي بين‌المللي را به‌منظور اولويت دادن به منافع و ارزش‌هاي عالي جامعۀ بين‌المللي فراهم آورد و آن را به واقعيتي عيني تبديل كند.

The evolution of international law led to the transition from coexistence to cooperation among independent States, but since the second half of the 20th century, a new concept emerged in some international law documents which regard international community and international law from different angle, focusing on priority of common interests and values. The study of legal rules and new international documents reflect their impact by the principle of international solidarity, such that it may be contended that the modern international law is passing through the State-centered stage to another arena, viewing the international community as a whole. The limitation of the States sovereignty in favor of the interests of the international community as a whole, including all human beings, due to the principle of solidarity, can ultimately lead to a structural transformation in the international legal system in order to prioritize the interests and values of the international community and make it objective reality.
