The place of the reasons of the revelation of verses in inferring the relious laws with emphasis on the verses about family health

توجه به شان نزول آيات الاحكام ناظر بر بهداشت جسمي، جنسي و رواني خانواده، ما را در فهم درست احكام مربوط به مراودات زناشويي و روابط خانوادگي ياري خواهد رساند. لذا در اين نوشتار تلاش نموده ايم ، به بررسي تاثير شان نزول در برداشت هاي فقهي از آيات با تاكيد بر آيات مرتبط با علوم پزشكي و بهداشت جسمي و رواني خانواده بپردازيم. پژوهش حاضر تحقيقي كاربردي بوده و با شيوه توصيفي- تحليلي و روش مطالعه كتابخانه اي و استنادي صورت گرفته و با كنكاش در آيات الاحكام و بهره گيري از روايات مستند و تحليل نظرات فقها، اهداف تحقيق دنبال شده است. در قرآن كريم قريب به سيصد آيه مرتبط با علوم پزشكي و بهداشت وجود دارد. پزشكي مشتمل بر «درمان و معالجه» و بهداشت به معني «پيشگيري» است. اما اكثر مطالب علمي قرآن درباره بهداشت و پيشگيري است. از اين روي، شناخت و بررسي شان نزول آيات قرآن در برداشت هاي فقهي از آيات الاحكام مرتبط با بهداشت جسمي و رواني خانواده نقش بسزايي دارد. تعيين مصاديق احكام كلي در آيات (در اين نوشتار آيات مرتبط با بهداشت خانواده)، تشخيص تخصيص حكم به سبب نزول يا عموم مكلفين، تمييز صحيح ناسخ از منسوخ و دستيابي به تناسب ميان احكام مندرج در آيات قرآن، تقييد و تحديد مفهوم و مصداق آيه بر افراد، تبيين فلسفه ي احكام الهي در راستاي شناخت مصالح و مفاسد احكام شرعي و تبيين واژگان مبهم در آيه را مي توان به عنوان نمونه هايي از تاثير شان نزول آيات كه ممكن است در راستاي استنباط صحيح احكام شرعي از آيات قرآن راه گشا باشند، برشمرد.

Paying attention to reasons of the revelation of the verses of the Ahkam on the physical, sexual and mental health of the family will help us to understand the laws related to marital relations and family relations correctly. Therefore, in this article, we have tried to examine the effect of the reasons of revelation in the jurisprudential interpretations of verses by emphasizing on the verses related to medical sciences and family physical and mental health. The present study is an applied research and has been done with descriptive-analytical method and library and citation study method and by researching the Ayatul Ahkam and using reliable narrations and analyzing the opinions of jurists. There are about three hundred verses in the Holy Quran related to medical sciences and health. Medicine includes "treatment" and health means "prevention". But most of the scientific content of the Qur'an is about health and prevention. Therefore, recognizing and examining the reasons of the revelation of Quranic verses plays an important role in the jurisprudential interpretations of the verses of the rules related to the physical and mental health of the family. Determining examples of general rules in verses (in this article, verses related to family health), recognizing the allocation of rules due to the reasons of revelation or generality of the obligors, distinguishing Sahih Mansukh from Nasikh and achieving proportionality between the Ahkam in the verses of the Qur'an, Taqayyud the Tahdid of content and application of the verse to individuals, explaining the philosophy of divine Ahkam to know the interests and corrupts of Ahkam and explaining ambiguous words in the verses can be considered as examples of the effect of the reasons of the revelation of verses that may be helpful in the correct inference of religious rules from the verses of the Qur'an.
