رويكرد انتقادي جهان سوم به حقوق بين الملل، با تاكيد بر نقد حقوق بشر

Critical Approach of the Third World to International Law , With Emphasis on Critique of Human Rights

حقوق بين الملل، دانشي است كه از سوي رويكردهاي گوناگون نقد شده، و نقش آن در تثبيت نابرابري و سلسله مراتب حاكم بر جهان مورد تاكيد و بررسي قرار گرفته است. «رويكرد جهان سوم به حقوق بين الملل» در موضع انتقادي خود به اين نظام، بر مصايب تاريخي محرومان و فرودستان جهان متمركز است، و انگشت اتهام را به خود حقوق بين الملل بعنوان يكي از عوامل مهم در تثبيت اين فرودستي، نشانه گرفته و آن را نقطه عزيمت خود قرار داده است. اين رويكرد انتقادي، نظام بين الملل حقوق بشر را نيز، برغم ظاهر فريبنده آن، از نقدهاي خود مصون نگذاشته است و بر كاركرد آن در مشروع سازي فرايندي كه منجر به تداوم و نيز استحكام اين نابرابري مي شود، تاكيد مي كند. در اين مقاله، با روش توصيفي، تحليلي، پس از واكاوي نقدهاي اصلي اين رويكرد به حقوق بين الملل، به بررسي ماهيت و اهداف آن، و نيز نقد اين رويكرد به حقوق بشر پرداخته خواهد شد.

International law is a field of knowledge that has been criticized by various approaches, and its role in establishing the inequality and hierarchy that govern the world has been studied and stressed. "Third World Approach to International Law" in its critical stance on this system focuses on the historical suffering of the deprived and the underprivileged people of the world, and points the finger of blame at international law itself as one of the important factors in establishing this inferiority. This critical approach has not ignored the international human rights system in its criticisms, despite its deceptive and justified appearance, and emphasizes its function in legitimizing the process that leads to the continuation and consolidation of this inequality. In this article, by descriptive-analytical method, after analyzing the main criticisms of this approach to international law, as well as the critique of this approach to human rights, its nature and purposes will be examined.
