چكيده فارسي :
زندان هم چنان در پهنه سياست جنايي مورد توجه ترين كيفرهاست. در پرتو اين مجازات آزادي آمد و شد بزه كاران براي دوره اي سلب مي شود. اجراء اين مجازات آن گاه عادلانه و از لحاظ كيفري اثربخش مي شود كه يك سلسله اصول بر آن ناظر باشد. شماري از اين اصول جنبه حقوق بشري دارند و دسته اي ديگر داراي ابعاد كيفرشناسانه اند. با شيوع ويروس كوويد19(كرونا) اجراء اين اصول با چالش هاي متعددي همراه شده است. زيرا، پيش از اين رعايت و تضمين آن ها با تكيه بر ظرفيت هاي محيط حقيقي صورت گرفته بود. اما، با پيدايش اين ويروس و چالش هاي پديد آمده در زمينه تضمين حق سلامت و آزادي هاي بنيادين زندانيان، بازپروري بزه كاران، بازدارندگي و توان گيري كيفري ضرورت شناسايي چاره براي كنارگذاري چالش ها و هم چنين بازنگري سياست جنايي اهميت يافته است.
از اين رو، سياست گذاران جنايي بايد به شناسايي كيفرهاي فناورانه، سياست هاي كيفري مناسب با وضعيت هاي اضطراري و در واقع ايجاد زمينه هاي مناسب براي حفظ هدف هاي عدالت كيفري و زندان در رويارو شدن جواع بشري با اين واقعيت ها مبادرت ورزند.
در اين نوشتار، با تكيه بر ظرفيت هاي سياست جنايي ايران اصول حقوق بشري اجراء كيفر زندان(الف)، و اصول كيفرشناسانه اجراء كيفر زندان(ب)پس از شيوع ويروس كوويد19(كرونا) بررسي شده اند تا در پرتو آن چالش هاي فرآيند كيفر دادن به بزه كاران در زندان كنار گذاشته و زمينه هاي مناسب براي رسيدن به هدف هاي بازپرورانه، بازدارندگي و توان گيري كيفري ايجاد شود.

Imprisonment is still one of the most notable punishments in criminal politics. In the light of this punishment, the freedom of movement of criminals for a period of time is taken away. The execution of this punishment becomes fair and criminally effective if it is supervised by a series of principles. Some of these principles are human rights and others are penological. With the outbreak of the Covid 19 virus (Corona), the implementation of these principles has been met with several challenges. Because, before that, their observance and guarantee had been done by relying on the capacities of the real environment. However, with the emergence of this virus and the challenges posed by guaranteeing the right to health and fundamental freedoms of prisoners, the rehabilitation of criminals, deterrence and criminal empowerment, the need to identify solutions to challenges as well as criminal policy review has become important. therefore, criminal policymakers must identify the technological penalties, appropriate penal policies for emergencies, and, in fact, create appropriate contexts for maintaining the goals of criminal justice and imprisonment in confronting human reality with these realities. this paper, based on the capacities of Iran's criminal policy, the principles of human rights in the implementation of prison sentences (a) and the penal principles of the implementation of prison sentences (b) are examined after the outbreak of the Cavid 19 virus (Corona).
