Analysis of the legal nature of Islamic Azad University

پس از پيروزي انقلاب اسلامي ايران، كمبود منابع انساني، جنگ تحميلي، تحريم‌هاي گسترده و نيز ساختار ناهمگون آموزش عالي با فضاي انقلابي باعث شد تا مسئولان وقت، تاسيس موسساتي خارج از ضوابط و ساختار دانشگاهاي دولتي را در دستور كار خود قرار دهند. هدف اين بود تا اين موسسات مستقل از بودجه دولتي باشد. از اين رو دانشگاه آزاد اسلامي در سال1361 تاسيس شد و در مدت كوتاهي اين دانشگاه در 14 واحد در سراسر كشور شروع به فعاليت كرد. سوال اصلي مقاله در اين باب است كه دانشگاه آزاد اسلامي در نظام حقوقي كشور چه ماهيت و جايگاهي دارد؟ دانشگاه آزاد اسلامي نخستين موسسه آموزش عالي غيردولتي غيرانتفاعي، پس از انقلاب اسلامي بوده و همچنين قرين با انقلاب اسلامي است. اين موسسه همواره از امتيازات خاص و ويژه اي چه در تاسيس، چه در گسترش برخوردار بوده است. اين امتيازات در عرصه هاي حقوقي، قانوني و مالي قابل مطالعه است. در نتيجه اين موسسه را نمي‌توان در زمره موسسات خصوصي و يا حتي هم‌رديف ديگر موسسات آموزش عالي غير انتفاعي غير دولتي دانست و به نظر مي‌رسد با توجه به ماهيت انقلابي آن طبق شواهد حقوقي موجود و اذعان مؤسسان آن، ماهيت حقوقي نظير نهادهاي عمومي و انقلابي خواهد داشت.

This institute has always had special privileges, both in its establishment and in its expansion. These privileges can be studied in legal, legal and financial fields. As a result, this institution can not be considered as a private institution or even the same level as other non-profit higher education institutions and it seems that due to its revolutionary nature, according to the available legal evidence and acknowledgment of its founders, legal nature such as institutions It will be public and revolutionary.
