Urban crisis management imperatives in terms of criminal law and Imamie jurisprudence

در اين مقاله اهميت نقش قوانين كيفري در مقابله با سوء استفاده‌هاي احتمالي از وضعيت بحراني و نيز اختلافات حقوقي ناشي از وقوع بحران‌ها و الزاماتي كه در فقه براي مديريت به طور كلي و مديريت بحران بخصوص مقرر شده است پرداخته مي‌شود. سؤال اصلي اين مقاله اين است كه از ديدگاه حقوق كيفري و به ويژه فقه اماميه ضرورت توجه به مديريت بحران‌هاي شهري چيست؟ فرضيه‌اي را كه براي پاسخگويي به اين سؤال اصلي در صدد تحليل و بررسي آن هستيم اين است كه به نظر مي‌رسد كه با توجه پيوند فقه و حاكميت سياسي و اجتماعي و حقوقي در ايران مديريت بحران‌هاي شهري از منظر فقه اماميه مي‌تواند به كارآمدي مديريت آن‌ها بسيار ياري رساند. روش انجام اين تحقيق با توجه به موضوع و اهداف و شيوه گردآوري اطلاعات به صورت توصيفي – تحليلي و از طريق بررسي متون قانوني و نظريات حقوقدانان و فقهاي در خصوص موضوع حاضر است. بر اين اساس جمع‌آوري اطلاعات به صورت كتابخانه‌اي و مراجعه به پايگاه‌هاي داده و جستجوي اينترنتي مقالات داراي درجه علمي معتبر و به روز رساني شده خواهد بود. ابزار گردآوري اطلاعات به صورت فيش‌برداري و بانك‌هاي اطلاعاتي است. روش تجزيه و تحليل در اين مقاله به صورت كيفي و استدلالي خواهد بود. بدين شيوه كه متغيرهاي موضوع را مورد بررسي قرار داده و ضمن توصيف و تحليل داده‌هاي گردآوري شده به صورت نظام‌مند به تبيين ابعاد مختلف موضوع پرداخته و با گذار از آنچه هست به آنچه بايد باشد، داده‌ها مورد استدلال قرار مي‌گيرند.

This article discusses the importance of the role of criminal law in dealing with possible abuses of the crisis situation as well as the legal disputes arising from the occurrence of crises and the requirements laid down in jurisprudence for general management and crisis management in particular. The main question of this paper is that from the perspective of criminal law and especially Imamiyyah jurisprudence what is the need to pay attention to urban crisis management? The hypothesis that we are trying to analyze and answer to this main question is that it seems that considering the link between jurisprudence and political, social and legal sovereignty in Iran, urban crisis management from Imamieh jurisprudence perspective can be very helpful in managing them. . The method of this research is descriptive-analytical considering the subject matter and the purpose and method of gathering information through review of legal texts and the opinions of jurists and jurists on this subject. Accordingly, the collection of information will be in a library and referenced to databases and Internet search of valid and updated scientific articles. The data collection tool is a database and database. The method of analysis in this paper will be qualitative and discursive. In this way, the subject variables are studied and systematically described and analyzed the data collected, explaining the different dimensions of the subject and arguing the data from what is to what should be.
