تحليل حمايت از حقوق پناهندگان در دولت محلي ايالت كاليفرنيا

Analysis of Refugee Rights in the Government of California

امروزه مسائل پناهندگان در جهان بيش از پيش در حال توجه و تأمل است و در ميان حمايت از حقوق آن‌ها اهميت دارد؛ در اين بين در كشورهايي كه در تقسيم‌بندي سياسي-جغرافيايي آن‌ها ايالت يا استان از خودمختاري و استقلال نسبي برخوردار است هركدام از ايالات قوانين و مقررات ويژه‌اي در ارتباط با پناهندگان و پذيرش آن-ها دارد. پژوهش حاضر با هدف بررسي تحليل حمايت از حقوق پناهندگان در دولت محلي ايالت كاليفرنياي آمريكا انجام شد. مطابق يافته‌هاي پژوهش حاضر، موضوع پناهندگان به طور رسمي در اسناد بين‌المللي به بعد از جنگ جهاني دوم و تأسيس سازمان ملل متحد برمي‌گردد. مطابق اين كنوانسيون دولت‌هاي متعهد حق اخراج، اعاده يا بازگرداندن پناهنده را ندارند و حقوق مروبط به كسب تابعيت و حق آزادي رفت و آمد را براي پناهندگان به رسميت مي‌شناسند. در اين كنوانسيون ساير حمايت‌هاي حقوق در حوزه اشتغال، حق مراجعه به دادگاه، آموزش و تأمين اجتماعي به رسميت شناخته شده است. در قوانين ايالات متحده آمريكا نيز مطابق اعلاميه حقوق و وظايف آمريكائي، ايالات‌متحده وظيفه دارد حقوق بشر همه پناهندگان را به طور يكسان اعم از مهاجرين قانوني و غير قانوني تضمين كند، كه شامل حقوق شخصي، آزادي، رفتار انساني، حداقل تضمين‌هاي دادرسي مناسب، برابري و عدم تبعيض و حمايت از زندگي خصوصي و خانوادگي مي‌باشد. در همين راستا دولت محلي كاليفرنيا انواع حقوق و حمايت‌هاي قانوني براي پناهندگان و فرزندان آن‌ها را فراهم كرده است كه مهم‌ترين آن‌ها در حوزه بهداشت و خدمات عمومي، آموزش، و كار است.

Each state has its own rules and regulations regarding refugees and their admission.The aim of this study was to analyze the protection of refugee rights in the local government of the state of California. According to the present study, the issue of refugees is officially covered in international documents after World War II and the establishment of the United Nations. Under the Convention, States Parties do not have the right to deport, reinstate or reinstate asylum seekers, and to recognize the right to citizenship and the right to freedom of movement for refugees. The Convention recognizes other rights in the field of employment, the right to a trial, education and social security.Under U.S. law, the United States has a duty to ensure that the rights of all refugees, both legal and illegal, are equal, including personal rights, liberty, human rights, and at least adequate legal guarantees. an‎d non-discrimination and protection of private and family life. In this regard, the local government of California has provided a variety of rights and legal protections for refugees and their children, the most important of which are in the areas of public health, education, and employment.
