چكيده فارسي :
قاعده ي حفظ نظام يكي از مهمترين قواعدي است كه در ذيل احكام ثانويه مورد مطالعه قرار گرفته و با توجه به گستردگي احكام قاعده ي مزبور در راستاي حقوق جزا، حقوق خصوصي و حقوق عمومي مي توان عنوان داشت كه اجراي احكام ناشي از حفظ نظام مي تواند با توجه به اجراي مفاد قواعد فقهي هم عرض همچون قاعده ي لاضرر، قاعده ي تسليط، قاعده ي يد، قاعده ي ضمان يد و... و در ذيل اصول حقوقي همچون اصل مصلحت، اصل لازم الاجرا بودن احكام، اصل در نظر گرفتن منافع جامعه، اصل قانوني بودن حكم و دهها اصل ديگر مورد بررسي قرار گيرد. قاعده ي حفظ نظام راه حلي در شرايط استثنايي است و فقها بر اساس اين قاعده، هر موضوعي را كه موجب اخلال نظام شود، حرام دانسته¬اند و به وجوب آنچه لازمه ي حفظ نظام است، فتوا داده‌اند و از اين رو موضوع اجراي صحيح اين احكام كه در راستاي حفظ نظام و پيشگيري از اخلال در نظام وضع گرديده از اهميت برخوردار مي باشد. از آنجا كه اعمال قاعده ي مزبور در راستاي اجراي حكم لازم الاجرا امكان پذير خواهد بود از اين رو مطالعه قواعد و اصول حاكم بر قاعده ي حفظ نظام در اجراي حكم از اهميت برخوردار است كه در دو بعد فقهي و حقوقي با توجه به روش كتابخانه اي و تحليل و توصيف مطالب در مقاله ي حاضر مورد مطالعه قرار مي گيرد.
