حمايت از محيط‌زيست و ضرورت آن بر كسي پوشيده نيست. حال اين حمايت‌ها جنبه‌هاي مختلفي همچون حمايت كيفري و يا غير كيفري دارد. برخي معتقدند هر چند قوانين كيفري در حفاظت محيط‌زيست نقش ايفاء مي‌كنند؛ ولي از آن جايي كه در اين زمينه مشكل اساسي عبارت است از تنظيم قانوني فعاليت‌هاي مؤسسات توليدي نسبتاً بزرگ، لذا مؤثرترين وسيله براي نيل به منظور تعيين معيارهاي دقيق مربوط به پخش و نشر مواد آلوده كننده و به كار بردن معيارها از طريق مقررات اداري مي‌باشد. قوانين كيفري نقش محدودي را در اين زمينه ايفاء مي‌كنند و همين نقش محدود را هم توأماً با اجراي مقررات اداري ايفا مي‌نمايند. برخي ديگر معتقدند حقوق جزا مناسب‌ترين روش براي حمايت از محيط‌زيست مي-باشد؛ زيرا اين حقوق عمده‌ترين وسيله حمايت مؤثر از ارزش‌هاي اساسي اجتماعي است و حالت خواركنندگي دارد. يافته‌هاي اين تحقيق نشان مي‌دهد كه به‌كارگيري هم‌زمان راهكارهاي كيفري با راهكارهاي غير كيفري و ادغام اصول حاكم بر آن‌ها با يكديگر بهترين راه براي حمايت و حفاظت از محيط‌زيست است؛ زيرا هركدام از اين موارد به تنهايي داراي معايب و محاسني است كه جز با ادغام آن‌ها نتيجه مطلوب حاصل نمي‌شود.
