چكيده فارسي :
تحقق وقف در اموال و اعيان خارجي مورد اتفاق است؛ اما نسبت به وقف منافع و حقوق اختلاف‌نظر است. يكي از مواردي كه نسبت به آن اختلاف است، وقف بخشي از اعمال انسان حرّ به صورت موقت يا دائم مي‌باشد. اين بحث تا آنجا كه مورد بررسي قرار گرفته، به صراحت در سخنان فقهاي اماميه به چشم نمي‌خورد. عدم طرح آن در ميان فقهاي اماميه شايد به دليل تنافي ظاهري آن با شرايطي باشد كه آنان براي وقف قائل شده‌اند.
هدف: از آنجا كه دامنه مباحث وقف امروزه گسترش يافته است و مصاديق جديد فراواني براي آن معرفي شده يا قابل تعريف است، لازم است بازنگري جديدي در موضوع وقف و شرايط آن صورت گيرد.
روش: نوشتار حاضر در پي آن است كه به صورت توصيفي ـ تحليلي مسئله «وقف عمل انسان حرّ» به صورت موقت يا دائمي را مورد واكاوي قرار دهد.
نتيجه: اين تحقيق روشن مي‌سازد بر اساس تعريفي كه از وقف با توجه به شرايط امروز مي‌توان ارائه داد، اين نوع وقف صحيح بوده و از مصاديق وقف صحيح قرار مي‌گيرد.
چكيده لاتين :
the realization of endowment (waqf) is conventional in property and concrete objects, but there is disagreement about the endowment of benefits and rights. One of the cases in which there is disagreement is the endowment (waqf) of a part of the actions of a temporary or permanent freeman. This discussion, as far as has been examined is not explicitly seen in the words of the Imami jurists. Its non-expression among Imami jurists may be due to its apparent contradiction with the conditions in which they have considered for endowment (waqf). Purpose: But since the extent of endowment (waqf) issues has expanded today and many new examples have been introduced or defined for it, it is necessary to re-review the endowment (waqf) subject and its conditions. Method: Therefore, the present article is going to analyze the issue of “endowment (waqf) of the action of the freeman” temporarily or permanently. Conclusion: This research clarifies that according to the definition of endowment (waqf) that can be provided according to today’s conditions, this type of endowment (waqf) is correct and is one of the examples of correct endowment.
