چكيده فارسي :
در دي ماه 1398، مطابق با دسامبر 2019، خبر ترور ناجوان‌مردانه قاسم سليماني، ابومهدي المهندس و همراهانشان در فرودگاه بغداد همه را شوكه كرد. كاخ سفيد و شخص ترامپ، رئيس‌جمهور ايالات متحده، مسئوليت دستور ترور وي و همراهانش را پذيرفت و اعتراف به قتل سردار سليماني كرد. متخصصان حقوق بين‌الملل از جهات مختلف به اين موضوع پرداختند؛ اما مسئله اصلي در اين تحقيق آن است كه: اصولاً آيا از منظر حقوق جزاي بين‌الملل امكان تعقيب عامل اين قتل و ترور ايشان و همراهانشان و نيز مجازات و اجراي حكم متناسب وجود دارد؟ همچنين كيفيت آن به چه صورت است؟ در مباحث حقوق كيفري بين‌المللي صلاحيت‌هاي واقعي سرزميني و جهاني نسبت به ساير عوامل، ظهور بيشتري در اين مسئله پيدا مي‌كند. به نظر مي‌رسد هم در محاكم بين‌المللي و منطقه‌اي و هم در كشورهاي مرتبط عراق، ايران و كشورهاي ثالث امكان تعقيب و محاكمه و اجراي حكم مسببان و مباشران، شامل ترامپ، عوامل ارتش آمريكا و ...، وجود خواهد داشت.
چكيده لاتين :
In Dey 1398 coinciding with December 2019, the news of the cowardly assassination of Qasem Soleimani, Abu Mahdi al-Mohandes and their companions at Baghdad airport shocked everyone. The White House and President Trump himself claimed responsibility for the assassination and confessed to killing General Soleimani. International legal experts have addressed this issue in various ways; but the main question in this research is: From the perspective of international criminal law, is it possible to prosecute the perpetrators of the assassination, as well as to punish them and execute a proportionate sentence? and if so, what is the procedure? In international criminal law, real territorial and global jurisdictions are more prominent than other factors. It seems that both in international and regional courts, as well as in the relevant countries of Iraq, Iran and third countries, it will be possible to prosecute and execute the perpetrators, including Trump, US military agents, etc.
