سازوكارهاي نظريِ برون‌رفت از چالش ميان شريعت و قانون در انديشه سياسي امام خميني(ره)

Theoretical Mechanisms against the Challenge between Sharia and Law in the Political Thought of Imam Khomeini (RA)

پس از پيروزي انقلاب اسلامي ادارۀ حكومت در چهارچوب احكام اوليۀ شريعت در عمل با بن‌بست‌هايي روبرو گرديد كه خروج از آنها جز با عبور از ظاهر شريعت ميسر نبود. اين مسئله، اجتهادات نويني را مي‌طلبيد كه توسط امام خميني صورت پذيرفت. بدين‌ترتيب صورت‌بندي خاصي از نسبت ميان قانون و شريعت موجب شكل‌گيري نظام سياسي در وجهي متفاوت گرديد. در اين مقاله با محوريت قرار دادن انديشۀ سياسي امام خميني و با روش توصيفي ـ تحليلي، به‌دنبال پاسخ به اين سؤال هستيم كه سازوكارهاي نظري پيرامون چالش ميان شريعت و قانون در انديشه سياسي امام خميني چيست؟ واكاوي انديشۀ سياسي امام خميني، اين پاسخ را به همراه داشت كه امام خميني با قرائت فقهي خاصي به‌واسطۀ مفاهيمي چون حكم حكومتي و اصل مصلحت، احكام ثانويه، و ولايت «مطلقه» فقيه سازوكاري براي حل چالش ميان شريعت و قانون ارائه داده‌اند.

After the victory of the Islamic Revolution, the administration of the government, within the framework of the basic rules of Sharia, in practice, faced deadlocks that could not be overcome except by going beyond the appearance of Sharia. This issue required new ijtihads that were carried out by Imam Khomeini. Thus, a special formulation of the relationship between laws and sharia led to the formation of a political system in a different way. In this article, focusing on Imam Khomeini's political thought and using descriptive-analytical method, we seek to answer the question: what are the theoretical mechanisms for the challenge between Sharia and laws in Imam Khomeini's political thought? An analysis of Imam Khomeini's political thought led to the answer that Imam Khomeini (ra) with a special jurisprudential reading through concepts such as government rule and the principle of expediency, secondary rules, and the "absolute" rule of the jurist presented a mechanism to resolve the challenge between Sharia and law.
