مطالعه تطبيقي بررسي صلاحيت هيات نظارت و شوراي عالي ثبت در نظام حقوق ايران و انگلستان

زمينه و هدف: با توجه به اهميت ثبت املاك در تنظيم امنيت اجتماعي و بستر سازي آن براي تثبيت معاملات و قديمي بودن قوانين ثبتي ايران در مقايسه با كشور هائي همانند انگلستان كه از نظر سيستم ثبتي پيشگام هستند، مطالعه و مقايسه سيستم ثبتي انگلستان مي تواند در ارائه راه‌حل ها و بهبود سيستم عملكرد و رفع خلاهاي قانوني در كشور ما موثر باشد. بدين منظور و با توجه به اهميت پژوهش، هدف پژوهش حاضر مطالعه تطبيفي بررسي صلاحيت هيات نظارت و شوراي عالي ثبت در نظام حقوق ثبت ايران با كشور انگلستان مي باشد. روش شناسي: در اين تحقيق روش كتابخانه اي مورد عمل قرار گرفته است و به قوانين، آيين نامه ها، قوانين خاص، بخش نامه هاي ثبتي و كتب، مقالات، پايان نامه هاي ثبتي در هر دو كشور رجوع شده است. يافته ها: هيات نظارت در ايران از دو قاضي و مدير كل ثبت استان يا قايم مقام او كه معاون يا كفيل ثبت منطقه است تشكيل مي شود. و در شوراي عالي ثبت صلاحيت رسيدگي به اشتباهات و اختلافات ثبتي و اظهار نظر در خصوص آنها را دارد. نتيجه گيري: تشكيلات سازماني مشابه با سازمان ثبت اسناد و املاك ايران در كشور انگلستان، اداره ثبت املاك و مستغلات مي باشد، شماي كلي امور ثبت و متولي آنها در كشور انگلستان نشان مي دهد كه مشابه ايران سازمان فوق به نظارت ثبت اسناد، املاك و مالكيت معنوي مي پردازد.

Methodology: In this research, the library method has been used and reference has been made to laws, regulations, special rules, registration letters and books, articles, registration dissertations in both countries. The supervisory board in Iran consists of two judges and the director general of the provincial registry or his deputy who is the deputy or guardian of the regional registry. an‎d in the High Council of Registration has the authority to deal with errors and registration disputes and to comment on them. Conclusion: The organizational structure similar to the Iranian Real Estate Registration Organization in the United Kingdom is the Real Estate Registration Office. The general outline of their registration and custodian affairs in the United Kingdom shows that similar to Iran, the above organization supervises the registration of real estate, real estate and Pays intellectual property.
