Legal Jurisprudential Foundations of Cryptocurrency with Investment Approach

زمينه و هدف: امروزه با ظهور شكل جديدي از فناوري‌هاي الكترونيكي همچون بلاك‌ چين و ارز ديجيتال، ساحت جهان با معناي جديدي از تئوري مك لوهان (دهكده جهاني) روبه‌رو شده است. بلاك‌چين فناوري نوين عصر حاضر است كه مرزهاي نظام‌هاي اقتصادي و سرمايه‌گذاري را دستخوش تغييرات روزافزوني كرده است. مواد و روش‌ها: اين تحقيق از نوع نظري بوده ‌روش تحقيق به‌ صورت توصيفي تحليلي ميباشد و روش جمع آوري اطلاعات به‌ صورت كتابخانه اي است و با مراجعه به اسناد، كتب و مقالات صورت گرفته است. ملاحظات اخلاقي: در تمام مراحل نگارش پژوهش حاضر، ضمن رعايت اصالت متون، صداقت و امانت‌داري رعايت شده است. يافته‌ها: فناوري بلاك‌چين بستري مهم براي توليد و انتشار ارز ديجيتال است كه به دنبال ظهور آن، چالش‌هاي حقوقي، اقتصادي و سرمايه‌گذاري فراواني مطرح شده است. يكي از چالش‌هاي كليدي و بسيار مهم هر فناوري نوظهور در اقتصاد و نظام سرمايه‌گذاري ايران، ديدگاه و فرامين شريعت در خصوص مشروعيت آن چيز است. مضاف بر اين، ديدگاه شرع در رابطه با ماهيت ارز ديجيتال، به‌عنوان پول در نظام اقتصادي و سرمايه‌گذاري جمهوري اسلامي نيز از اهميت شاياني برخوردار است. نتيجه‌گيري: درخور توجه است كه ديدگاه‌هاي متفاوتي در خصوص ماهيت ارز ديجيتال مطرح شده است كه در اين ميان، ديدگاه پول بودن كريپتوكارنسي قوت بيشتري دارد. به دنبال آن، ماليات يكي از مهم‌ترين اهرم‌هاي نظام سرمايه‌گذاري و افزايش درآمد دولت‌هاست؛ لذا ستانيدن ماليات از فعالان عرصه‌ي ارزهاي ديجيتال و ماينرها (استخراج‌كنندگان ارزهاي ديجيتالي)، درآمد هنگفتي براي خزانه كشور به همراه خواهد داشت.

Background and Aim: In the mid-20th century, the theory of the world village was presented by Marshal McLuhan. McLuhan believed that the world would be surrounded by electronic technology and the borders would become a global village. But today, with the advent of a new form of electronic technologies such as blockchain and Cryptocurrency, the imagined changes in the world are facing a new meaning for McLuhan's theory. Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Findings: Blockchain is a modern technology of the present era, created by the maker of the so-called Internet of Things. Clearly Blockchain technology is an important platform for the production and diffusion of Cryptocurrency, which poses many legal challenges following its emergence in the field of communications. One of the key challenges of any emerging technology in the Iranian economy is the view of the Sharia regarding the legitimacy of that thing. Conclusion: In addition to this Shariah's view of the nature of the Cryptocurrency, as money in the Islamic Republic's economic system, it is also very important. It is noteworthy that different views have been raised on the nature of digital currency, among which the author has accepted the view that a digital currency is money.
