فناوري نظارت الكترونيكي؛ راهبردي نو براي مديريت ازدحام و جرايم مأموران انتظامي زندان‌ها

Electronic surveillance technology; A new strategy for management Congestion and crimes of prison police officers

زمينه و هدف: در فناوري نظارت الكترونيكي، دادگاه به‌جاي سلب آزادي محكوم و حبس وي، آزادي متعارف رفت‌وآمد او را به‌صورت ديگري محدود مي‌كند. مراقبت با دستگاه‌هاي الكترونيكي، ازنظر اصول مورد تأييد در مقررات بين‌المللي، به‌خصوص در ارتباط با بزهكار داراي جرائم سبك همچون استفاده حداقل از مجازات حبس، عدم برچسب‌زني و عدم جدايي بزهكاران از خانواده مگر در موارد ضروري، مطابقت دارد. همچنين با توجه به امكان ارتكاب جرم توسط مأموران انتظامي زندان‌ها، استفاده از فناوري نظارت الكترونيكي در زندان‌ها مي‌تواند نقش قابل‌توجهي در كاهش جرائم ارتكابي آنها داشته باشد. روش‌شناسي تحقيق: تحقيق حاضر از نوع تحقيقات كيفي بوده و ازنظر هدف، كاربردي و به روش تحليل محتوا صورت گرفته است. در تنظيم پژوهش، از روش اسنادي و كتابخانه‌اي استفاده ‌شده و تجزيه‌وتحليل اطلاعات كسب ‌شده به‌صورت كيفي و مبتني بر استنتاج محقق از منابع و متون بوده است؛ از همين رو، درصدد معرفي اجمالي فناوري نظارت الكترونيكي به‌عنوان راهبردي نو در راستاي مديريت جمعيت كيفري زندان‌ها و كاهش جرائم مأموران انتظامي زندان‌ها با استفاده از اين فناوري است. يافته‌ها و نتيجه‌گيري: يافته‌هاي اين تحقيق حاكي از اين است كه فناوري نظارت الكترونيكي مي‌تواند جايگزيني نو براي مديريت ازدحام زندان‌ها در ايران نيز مطرح شود؛ زيرا تحقيقاتي كه در ايران صورت گرفته نشان مي‌دهد كه 62 درصد مردم معتقدند كه مي‌توان از مجازات‌هاي اجتماعي غير از زندان براي بزهكاران استفاده كرد. همچنين با توجه به تبيين جرائم ارتكابي مأموران انتظامي در زندان‌ها بر مبناي نظريه‌هاي جرم‌شناسي و تأثير نظارت الكترونيك به‌عنوان راهبردي نو در كاهش جرائم ارتكابي آنها و استفاده از اين فناوري با استفاده از چك‌ليست‌هاي ارائه شده در راستاي كاهش جرائم مأموران انتظامي زندان‌ها بسيار تأثيرگذار است. كمااينكه كاهش جمعيت زندانيان و كنترل محيط زندان با فناوري نظارت الكترونيكي به كاهش جرائم مأموران انتظامي زندان‌ها منجر مي‌شود.

Background and Aim: In electronic surveillance technology, instead of depriving a convicted person of his or her liberty and imprisonment, the court restricts his or her normal freedom of movement in another way. Surveillance with electronic devices is in line with the principles enshrined in international law, especially concerning to light-crime offenders such as the use of a minimum of imprisonment, non-labeling and separation of offenders from the family unless in necessary situations. Also, considering the possibility of committing a crime by prison law enforcement officers, the use of electronic surveillance technology in prisons can play a significant role in reducing the crimes committed by them. Methodology: The present research is applied in terms of purpose and content analysis method. In organizing the research, the documentary method and libraries used and the analysis of the obtained information was qualitative and based on the researcher's inference from sources and texts; therefore, it seeks to briefly introduce electronic surveillance technology as a new strategy for managing the prison population and reducing the crimes of prison law enforcement officers using this technology. Findings and Conclusions: The findings of this study indicate that electronic surveillance technology can be a new alternative to congestion prison management in Iran; Because a survey conducted in Iran shows that 62% of people believe that social punishments other than imprisonment can be used for criminals. Also, considering the explanation of crimes committed by law enforcement officers in prisons based on criminological theories and the effect of electronic surveillance as a new strategy in reducing their crimes and using this technology using checklists provided to reduce crimes of prison law enforcement officers is very effective. Similarly, reducing the prison population and controlling the prison environment with electronic surveillance technology will reduce the crimes of prison law enforcement officers.
