پيشگيري از تضييع حقوق شهروندان در پرتو بازتعريف دولت در قالب حكمراني مطلوب

Preventing the violation of citizens' rights in the light of redefining the government in the form of good governance

زمينه و هدف: برابري، عدالت، امنيت قضايي و حق بهره برداي و تامين حق از مهمترين مباني حقوق شهروندي مي باشد. همچنين بارزترين اثر و كاركرد حقوق شهروندي حكمراني خوب است كه مولفه هاي حقوق فردي و گروهي در حقوق عمومي و قضايي را شامل مي گردد. بر اين اساس به دنبال پاسخ به اين سوال هستيم كه مولفه هاي حكمراني مطلوب چگونه مي تواند موجب پيشگيري از تضييع حقوق شهروندان گردد؟ روش پژوهش: باتوجّه به ماهيّت موضوع، پژوهش حاضر از نظر هدف كاربردي و به لحاظ گردآوري اطلاعات به روش اسنادي و از طريق مطالعه قوانين انجام شده و اطلاعات به دست آمده به صورت توصيفي- تحليلي مورد تجزيه وتحليل قرار گرفته است. يافته ها و نتيجه گيري: مبناي حقوق شهروندي در حوزه هاي مختلف است. مبناي هر حق نيز يك الزام اجتماعي است كه در جامعه پذيري افراد نهفته است. بنابراين حق شهروندي نه صرفا مبتني بر حقوق بلكه معطوف به تعهدات تبيين يافته در يك جامعه است، چرا كه افراد ارتباط نزديكي ميان سرنوشت خود و جامعه احساس مي كنند، بنابراين جايگاه حقوق شهروندي در حقوق داخلي كه در حق ها نهفته است ايجاد يك رشته قواعد منسجم ميان موضوعات «امنيت» و «نظم» ناظر بر جامعه اي است كه بر بنيان هاي خاص شكل گرفته است.در اين ميان بازتعريف دولت در قالب مولفه هاي حكمراني مطلوب شامل حق اظهارنظر و پاسخگويي، ثبات سياسي و مقابله با خشونت، اثر بخشي دولت، كيفيت مقررات، قانون مداري و كنترل فساد مي تواند موجب پيشگيري از تضييع حقوق شهروندان گردد

Field and Aims: Equality, justice, judicial security and the right to exercise and ensure the right are the most important principles of civil rights. Also, the most obvious effect of civil rights is good governance, which includes the components of individual and group rights in public and judicial law. Accordingly, we seek to answer the question of how the components of good governance can prevent the violation of citizens' rights? Methodology: Due to the nature of the subject, the present study has been done in terms of practical purpose and in terms of collecting information by documentary method and by studying valid laws and sources and the obtained information has been analyzed descriptively-analytically. Findings and Conclusion: It is the basis of civil rights in the civil, political, economic and social fields. The basis of every right is a social obligation that lies in the socialization of individuals. Thus, citizenship is not only based on rights but also on the obligations explained in a society, because people feel a close connection between their destiny and society, so the place of citizenship rights in domestic law that lies in rights is to create a set of rules. Coherent between the issues of "security" and "order" refers to a society that is formed on specific foundations. Government, quality of regulation, rule of law and control of corruption can prevent the violation of citizens' rights.
