The performance of the courts of justice in Bushehr port during the constitutional period, the causes and factors of its failure

با انقلاب مشروطيت و ايجاد تحول در نظام دادرسي، اجراي عدالت وبرقراري امنيت اجتماعي ازمهم ترين مطالبات سياسي مردم بندر بوشهر بود. اين منطقه در يكي از حساس ترين برش هاي تاريخي عصر قاجار، يعني دوران گذار از جامعه سنتي به سمت مدرنيته، در زمينه حيات اجتماعي و سياسي شاهد تحولات عميقي بود. مقاله پيش رو درصدد است تا با رويكردي نسبتا جامع بر مبناي مندرجات مطبوعات و نشريات، اسناد آرشيوي و كتب، با بهره مندي از روش تحقيق تاريخي مبتني بر توصيف و تحليل داده هاي تاريخي، علل ناكارآمدي محاكم عدليه در بندر بوشهر را مورد بررسي تاريخي قرار دهد.اين پژوهش در پي پاسخ به اين پرسش است كه عدليه بندر بوشهردر انقلاب مشروطه با چه موانعي مواجه بوده است؟ به نظر مي رسد، عواملي هم چون، عدم تحول ساختارهاي اجتماعي و سياسي لازم در كشور، ناكارآمدي دولت در تامين مالي وگرداندن عدليه ، فقدان قوانين منسجم ومدون نظام قضايي، دخالت و نفوذ قدرتهاي محلي مانند فشارها و اغتشاشات ايلات ونفوذ سياسي رعاياي خارجي از موانع جدي فعاليت هاي عدليه در بندر بوشهر بود.

With the constitutional revolutionand the fundamental change in the judicial system, the implementation of justice and the establishment of social security were among the most important political demands of the people of the Iranian ports of the Persian Gulf. This region witnessed profound changes in one of the most sensitive historical sections of the Qajar era, namely the transition from traditional society to modernity in the field of social and political life. The present article seeks to historically investigate the causes and factors of judicial inefficiency in these ports with a relatively comprehensive approach based on the contents of press and publications archival documents and books, using the historical research method based on the description and analysis of historical data.
