Challenges of realizing the rights of victims of crimes of legal entities

بزه ديدگان جرايم اشخاص حقوقي در فرايند دادرسي كيفري، از طرح دعوي گرفته تا تعقيب، رسيدگي و اجراي حكم عليه اشخاص حقوقي با چالش هاي متعددي مواجه اند اين بزه ديدگان جهت احقاق حق خود در دادرسي عليه شخص حقوقي با مشكلات و موانع تقنيني و دادرسي برخورد مي كنند كه همين مشكلات و چالش ها سبب عدم تحقق احقاق حقوق اين افراد شده و در نتيجه راه را براي تكرار جرم شخص حقوقي باز خواهد گذاشت. جرايم اشخاص حقوقي به نحوي هستند كه در بسياري از موارد به دليل نقص قانون، ايرادات دادرسي و عدم حمايت قانونگذار از قربانيان جرايم اشخاص حقوقي، اين اشخاص يا مجازات نمي شوند و يا مجازاتي سبك براي آنها در نظر گرفته مي شود و در مواردي نيز محكوميت آنها با تاخير و روند طولاني دادرسي مواجه مي شود در حالي كه آثار سوء جرايم اين اشخاص اگر بيشتر از آثار جرايم شخص حقيقي نباشد قطعا كمتر نخواهد بود لذا اين اشخاص يقينا بايد مستحق مجازات سنگين تري باشند. پژوهش حاضر تلاش دارد به روشت نوصيفي - تحليلي و با استفاده از منابع كتابخانه اي به شناسايي و بررسي اين موانع و چالشها بپردازد و در خصوص آنها اقدام به پيشهاد و ارايه راهكار نمايد.

Victims of crimes of legal entities in the criminal proceedings, from filing a lawsuit to prosecuting, prosecuting and enforcing sentences against legal entities, face many challenges in order to exercise their right to a trial against a legal entity, encountering legislative problems and obstacles. They say that the same problems and challenges have led to the non-realization of the rights of these people and as a result will open the way for the recurrence of the crime of a legal person. The crimes of legal persons are such that in many cases, due to the flaws of the law, the objections of the trial and the lack of protection of the victims of the crimes of legal persons, these persons are either not punished or a light punishment is considered for them and in some cases conviction. They face delays and a long trial, while the misdemeanors of these people will certainly not be less if they are not more than the crimes of a real person, so these people should definitely deserve a heavier punishment. The present study tries to identify and study these obstacles and challenges in a descriptive-analytical way and using library resources and to propose and provide solutions for them.
