امكان‌سنجي اجراي سياست قانوني‌سازي مواد مخدر در نظام عدالت كيفري ايران با رويكرد تطبيقي

Feasibility Study of Implementing Legalization of Illegal Drugs in the Iranian Criminal Justice System with Comparative Approach

هرچند قانوني‌سازي مواد مخدر اغلب تحت تأثير ديدگاه «جرم‌انگاري» در حاشيه قرار گرفت، ولي در سال‌هاي اخير در سياست كيفري برخي كشورها، مانند كانادا، اروگوئه و بعضي ايالت‌هاي امريكا، مادۀ مخدر كانابيس به‌مثابه رويكرد اصلي جايگزين شده است. در نظام عدالت كيفري ايران نيز به‌رغم آنكه همواره بر رويكرد جرم‌انگاري در حل مشكل مواد تأكيد شده است، ولي نتايج پژوهش‌ها هيچ‌گاه از اثربخشي آن حمايت نكردند. با توجه به تحولات اخير، اين پرسش طرح مي‌شود كه آيا در نظام عدالت كيفري ايران نيز امكان اجراي سياست قانوني‌سازي در مورد كانابيس وجود دارد؟ براي پاسخ به اين پرسشِ پژوهش تلاش كرديم تا با اتكا بر تلفيقي از روش تحليل محتواي كيفي و مطالعۀ تطبيقي جريان‌هاي مؤثر بر قانوني‌سازي كانابيس در ايالات متحدۀ امريكا، به جمع‌آوري، كدگذاري و تحليل داده‌ها بپردازيم. يافته‌هاي پژوهش بيانگر تمركز بر پزشكي‌سازي حوزۀ كنترل مواد مخدر است تا به واسطۀ تأكيد بر درمان مصرف‌كنندگان، به بحران مواد مخدر پايان داده شود. اين مقدار توجه، از اهميت درك پيامدهاي منفي اين رويكرد مي‌كاهد و تغيير الگوي مصرف جامعه و مسئلۀ جرم‌زدايي را ناديده مي‌گيرد؛ حال آنكه وجود اين موارد امكان طرح سياست قانوني‌سازي كانابيس را محتمل توصيف مي‌كند.

Drug legalization has often been marginalized under the influences of Criminalization approach, but in recent years, it has become the main policy of in Canada, Uruguay and some states of US in relation to cannabis. In Iranian criminal justice system, although the criminalization approach has always been emphasized, but the evaluation studies indicate the ineffectiveness of these policies. With regards to these circumstances, it is necessary to ask the question whether it is possible to formulate a legalization policy on cannabis in the Iranian criminal justice system or not? So, we collected, coded and analyzed data using qualitative content analysis method and comparative study of cannabis legalization policy in the United States. The findings of the study indicate a focus on medicalization in controlling drugs, which leads to ignoring its negative consequences including cultural dimension of drugs. Whereas the consumption pattern and decriminalization approach should be considered as important variables in legalization policy for cannabis.
