جايگاه و كاركرد كميتۀ مشورتي شوراي حقوق بشر در نظام بين‌المللي حقوق بشر

Status and Function of the UN Human Rights Council Advisory Committee in the International Human Rights System

به‌منظور تقويت نقش ارتقايي و نظارتي نهاد حقوق بشر سازمان ملل متحد، شوراي حقوق بشر موظف شد تا اختيارات، فعاليت‌ها و سازوكارهاي كميسيون حقوق بشر سابق را بازنگري و ساختار شورا را سازماندهي كند. بر اين اساس كميته‌اي با عنوان «كميتۀ مشورتي» ايجاد شد كه اين تحقيق با هدف شناخت و بررسي عملكرد اين نهاد در شوراي حقوق بشر صورت گرفته است. بررسي نقش و عملكرد كميتۀ مشورتي نشان داد كه كميتۀ مشورتي در شوراي حقوق بشر نقش «مشاور بين‌المللي»را بر عهده دارد و در مواردي توصيه‌نامه صادر مي‌كند. كاركرد ديگر كميتۀ مشورتي، فراهم آوردن «فضا و عرصه‌اي مناسب» براي تبادل‌نظر و گفت‌وگو ميان كارشناسان كميتۀ مشورتي، نمايندگان دولت‌ها و سازمان‌هاي غيردولتي در زمينۀ مسائل حقوق بشر است. كميتۀ مشورتي از طريق مطالعات، تهيۀ گزارش‌ها و پيش‌نويس برخي اسناد بين‌المللي در شكل‌گيري افكار عمومي، اطلاع‌رساني و افزايش دانش و توليد اطلاعات در زمينۀ مسائل مختلف حقوق بشر تأثيرگذار بوده و موجب ترويج و حمايت حقوق بشر و ارتقاي عملكرد شوراي حقوق بشر شده است.

Human Rights Council Advisory Committee is a consultative body of the Human Rights Council that provides the council's requested consultations. Its studies and reports lead to draft some international instruments. It is important to recognize the advisory committee to understand the mechanisms of the UN system for protecting human rights. The present study was designed to identify the advisory committee and examine and review its function and role. This research has shown that the Advisory Committee has an international advisory role and it issues recommendations. Another function of the advisory committee is providing suitable area to interact, exchange ideas, debate, and dialogue between experts of the Advisory Committee and representatives of governments and NGOs about human rights issues. The Advisory Committee protects and promotes human rights through shaping public opinion, informing and increasing knowledge and information production on various human rights issues through studies, preparing reports, and drafting some international instruments. The Advisory Committee has strengthened the functions and efficiency of Human Rights Council.
