تاثير جامعه و زمينه هاي اجتماعي در فقه، از جمله مباحث كليدي و حايز اهميت به شمار مي رود. اين تاثير در انديشه و آراي امام ، به عنوان شخصيتي تاثيرگذار ، بسيار اهميت دارد. در اين مقاله تلاش شده، ابتدا چارچوب نظري بحث بر پايه خوانش امام خميني از مفهوم مصلحت در پرتو نظريه فقه پويا و فقه حكومتي و همچنين تربيت و اصلاح به عنوان يكي از ارزش هاي مهم انقلاب اسلامي بررسي شود و در ادامه جلوه هاي تاثير انديشه امام خميني (ره) بر مجازات ها در دو دهه اخير انقلاب اسلامي تبيين و تحليل شده است. نتايج تحقيق حاكي است تحت تاثير انديشه هاي امام خميني (ره) در خصوص رعايت و توجه به مفهوم مصلحت به ويژه در زمينه قانون گذاري و توجه به مقوله اصلاح و تربيت به عنوان هدف مجازات، صورت گرفته است. امام خميني (ره) معتقد به تاثير و تاثر متقابل فرد و جامعه بر يكديگر بودند و بر اين اساس توجه به اصلاح و بهبود زندانيان با استفاده از روش هاي مختلف از جمله بهره گيري از مجازات هاي جايگزين حبس در راستاي تحقق جامعه مطلوب و سالم، ضروري است.
