تحليل نقد ديدگاه فمينيستي از تعاريف معلول و معلوليت در اسناد حقوقي ايران و اسناد بين المللي

Analyzing the Critique of Feministic View Relating to Definitions of the Disabled and Disability in Iranian Legal Documents and International Instruments

سوزان وندل، فيلسوف فمينيست، نقدهايي از منظر فمينيستي به تعاريف رايج از معلوليت در اسناد حقوقي جهاني وارد كرده است. از نظر او، بايد در تعريف معلوليت در سند مهم سازمان بهداشت جهاني در سازمان ملل تغييراتي ايجاد شود. اول از همه بايد پذيرفته شود كه ساختار و كاركرد طبيعي و توانايي طبيعي براي انجام فعاليت ­ها، بستگي به محيط جسمي، اجتماعي و فرهنگي ­اي دارد كه فرد در آن زندگي مي­ كند. بر اين پايه، نه تنها در بعد سياسي و اجتماعي و فرهنگي كه حتي در بعد زيستي هم معلوليت به هيچ وجه نمي تواند تعريف واحدي پيدا كند. در نتيجه ما با يك تعريف واحد از معلوليت سروكار نداريم، بلكه با «تعاريف» معلوليت سروكار داريم و سازمان بهداشت جهاني اصولاً نمي ­تواند يك تعريف واحد را جهاني كند. دوم در تعاريف از معلوليت بايد به تنوع بسيار زياد در خود معلولان توجه گردد و حتي معلوليت­ هاي مشترك بدون اشتراك در جنسيت، طبقه، نژاد و سن نبايد در يك گروه تعريفي گنجانده شود. سوم اينكه در تعاريف درست از معلوليت بايد محدوده­اي را براي كساني كه دچار تضاد در هويت معلوليت يا بحران هويت معلوليت شده ­اند ، تعيين كرد تا در دسته سالم يا معلول جا نگيرند و بتوانند فرصت و انرژي كافي براي حل چالش خود داشته باشند. و چهارم اين­كه تمايز دقيق ميان بيمار و معلول به صلاح هيچ بيمار و معلولي نيست، بلكه بيشتر به نفع سازمان­ هاي حمايت از بيماران و معلولان است كه از تعداد مراجعان و هزينه­ هاي خود بكاهند. ديدگاه وندل قابل نقد است و آن اين­كه در تعريف معلوليت نمي ­توان از الفاظ خنثي، نسبي و فرهنگي استفاده كرد و اين كار نقض غرض در دفاع از حقوق معلولان است. در عوض، مي ­توان ميان تعريف شخص داراي معلوليت و تعريف ويژگي معلوليت تفاوت گذاشت.

Susan Wendell, a feminist philosopher, has made feminist critiques of common definitions of disability in universal legal documents. According to her, changes should be made in the definition of disability in the important document of the World Health Organization (WHO) in the United Nations. First and foremost, it must be accepted that the natural structure and function and the natural ability to perform activities depend on the physical, social and cultural environment in which one lives. Accordingly, not only in the political, social and cultural dimensions, but even in the biological dimension, disability cannot find a single definition. As a result, we are not dealing with a single definition of disability, but we are dealing with "definitions" of disability and WHO, in principle, cannot universalize a single definition. Second, in the definitions of disability, great diversity should be considered in the disabled themselves, and even common disabilities without sharing in gender, class, race and age should not be included in a definition group. Third, in the correct definitions of disability, a limit should be set for those who have a conflict in the identity of the disability or the crisis of the identity of the disability, so that they do not fall into the category of healthy or disabled and can have enough time and energy to solve their challenge. an‎d fourth, the exact distinction between patient and disabled is not in the best interest of either patient or disabled, but rather in the interest of patient support organizations and disability support organizations to reduce the number of clients and their costs. Wendell can be criticized for not using neutral, relative and cultural terms in the definition of disability, and this is in contrast with the purpose of defending the rights of persons with disabilities. Instead, one can distinguish between the definition of a person with a disability and the definition of a characteristic of a disability.
