با انعقاد عقد نكاح، تعهداتي بين زوجين ايجاد مي شود ازجمله تعهد زوجه به زوج در مسأله تمكين است. در دنياي معاصر كه زنان نيز مانند مردان بسياري از مشاغل و تكاليف اجتماعي را عهده دار شدند و مجبور به خروج از منزل هستند، تمكين از زوج در هر ازمنه براي آنان ميسر نيست. تزاحم اشتغال زنان در جامعه با حق تمكين زوج، چالشي است كه گريبانگير بعضي از خانواده ها شده است و در برخي از موارد اسباب مشاجرت زوجين را فراهم مي آورد.مشهور فقهاء، استيذان از زوج را به طور مطلق واجب مي دانند و برخي ديگر آن را به منافات نداشتن با استمتاعات زوج مقيد نمودند. اين پژوهش كه به روش تجزيه و تحليل سامان يافته است به منظور پاسخگويي به اين پرسش است كه آيا تعيين زوج به عنوان رياست خانواده در فقه و حقوق ايران موجب سلطه جويي و اقتدار بي قيد و شرط برخي از مردان نخواهد شد؟ مقاله بر اين عقيده تأكيد مي ورزد از آنجايي كه تمكين به عنوان حقي از حقوق زوج در ذات عقد نكاح لحاظ نشده است؛ لذا زوجه شاغل با عنايت به شرايط شغلي خود مي تواند مقدار تعهد خود را نسبت به تمكين در حين عقد به صورت صريح و شفاف مطرح نمايدو با استفاده از شرط ضمن عقد، انتظارات زوج را در اين امر تعديل نمايد.

In the contemporary world, where women, like men, have undertaken many jobs and social tasks and are forced to leave home, it is not possible for them to obey in any way. Encouraging women to work in a well-off society is a challenge that has plagued some families and, in some cases, provided the couples with a misconception. They were bound to disagree with the couple's arguments. This research, organized by the analysis method, aims to answer the question whether the appointment of a couple as the head of the family in Iranian jurisprudence and law will not lead to unconditional domination and authority of some men. The article emphasizes this view since obedience is not considered as a right of couples in the essence of marriage; therefore, a working wife can express her commitment to obedience during the marriage expressly and conclusively. Be transparent and adjust the couple's expectations using the condition of the contract.
