بررسي عوامل فردي مؤثر بر ضرب و جرح مأموران نيروي انتظامي از منظر فقه و حقوق (مطالعه موردي نيروي انتظامي استان سمنان)

Investigating the individual factors affecting the beating and wounding of law enforcement officers from the perspective of jurisprudence and law (Case study of the police force of Semnan province)

نيروي انتظامي مهم ترين سازمان متولي نظم و امنيت در جامعه است كه پرداختن به مسايل و مشكلات رفتاري آنان، ضروري به نظر مي رسد. ماموران با ابزارهاي قانوني به ايجاد امنيت و نظم مي پردازند، اما؛ گاهي برخي ماموران در هنگام اجراي وظيفه سبب ايراد ضرب و جرح نسبت به متهمان مي گردند؛ اعمال خشونت ماموران نسبت به متهمان، شاخص هاي امنيت و اعتماد اجتماعي را كاهش مي دهد. هدف پژوهش حاضر شناسايي روش هاي موثر پيشگيري كيفري از جرايم با محوريت جرم ضرب و جرح كاركنان نيروي انتظامي و اولويت بندي آنها مي باشد. اين تحقيق از نظر نوع كاربردي و از نظر روش تحقيق توصيفي پيمايشي است، با توجه به ابعاد متغيرهاي تحقيق از روش كمي استفاده شده است. جامعه آماري آن ماموران نيروي انتظامي استان سمنان است كه 66 نفر به صورت تصادفي با شيوه نمونه گيري احتمالي طبقه اي نظام مند انتخاب شدند كه پرسشنامه در اختيار آن ها قرار گرفت و اعتبار آن از طريق اعتبار محتوي و پايايي آن از طريق محاسبه كرونباخ (94%=a) مورد ارزيابي و سنجش قرار گرفت. براي محاسبه حجم نمونه از آزمون كوكران استفاده گرديد. مهم ترين يافته هاي به دست آمده از تحليل داده ها بيانگر آن است كه از عوامل فردي موثر بر بروز خشونت، راضي نبودن از حقوق و مزايا در رتبه اول، نارضايتي از شغل خدمتي در رتبه دوم و وجود روحيه خشونت و تندخويي در رتبه سوم قرار دارد.

The police force is the most important organization in charge of order and security in the society, and it seems necessary to address their behavioral issues and problems. Officers use legal means to establish security and order, but; Sometimes, some officers inflict beatings on the accused while on duty; Officers' violence against defendants reduces indicators of social security and trust. The purpose of this study is to identify effective methods of criminal prevention of crimes focusing on the crime of assault and injury of law enforcement personnel and their prioritization. This research is a survey in terms of type of application and descriptive in terms of research method. Due to the dimensions of research variables, a quantitative method has been used. The statistical population is the police officers of Semnan province that 66 people were randomly selected by probabilistic sampling of systematic classes who were given a questionnaire and its validity through content validity and its reliability through Cronbach's calculation (a = 94%) Was evaluated. Cochran's test was used to calculate the sample size. The most important findings obtained from data analysis indicate that individual factors affecting the incidence of violence, dissatisfaction with salaries and benefits in the first place, dissatisfaction with the job in the second place and the presence of a spirit of violence and aggression in the third place has it.
