ﻫﺪف از اﻧﺠﺎم اﯾﻦ ﺗﺤﻘﯿﻖ" ﺑﺮرﺳﯽ ﺧﻼﻫﺎي ﻗﺎﻧﻮﻧﯽ ﻧﺎﻇﺮ ﺑﺮ ﺑﺎزرﺳﯽ ﻣﻨﺎزل و اﻣﺎﮐﻦ ،ﺑﺎزرﺳﯽ ﺧﻮدرو و اﺳﺖ و ﺑﺎزرﺳﯽ در ﻗﺎﻧﻮن آﯾﯿﻦ دادرﺳﯽ ﮐﯿﻔﺮي ﺳﺎل 1392 ﻣﯿﺒﺎﺷﺪ اﯾﻦ ﺗﺤﻘﯿﻖ ﺑﺮﺣﺴﺐ ﻫﺪف ازﻧﻮع ﮐﺎرﺑﺮدي ﻣﺴﺎﻟﻪ ﻣﺤﻮر ﻣﯽ ﺑﺎﺷﺪﮐﻪ اﻃﻼﻋﺎت ﻣﻮرد ﻧﯿﺎز ﺗﺤﻘﯿﻖ ﺑﻪ روش اﺳﻨﺎدي ﺟﻤﻊ آوري ﺷﺪه و ﺳﭙﺲ ﺑﻪ روش ﺗﺤﻠﯿﻠﯽ و ﺗﻮﺻﯿﻔﯽ ﻣﻮرد ﺗﺠﺰﯾﻪ و ﺗﺤﻠﯿﻞ ﻗﺮار ﻣﯽ ﮔﯿﺮد. روش ﺗﺤﻘﯿﻖ ﺑﻪ ﺻﻮرت ﮐﺘﺎﺑﺨﺎﻧﻪ اي ﻣﯽﺑﺎﺷﺪ.در اﯾﻦ ﭘﮋوﻫﺶ دو ﺳﻮال ﻣﻄﺮح ﺷﺪه اﺳﺖ ﺷﺎﻣﻞ ﺧﻼء ﻫﺎي ﻗﺎﻧﻮﻧﯽ ﻧﺎﻇﺮ ﺑﺮ ﺑﺎزرﺳﯽ ﻣﻨﺎزل و اﻣﺎﮐﻦ ، اﯾﺴﺖ وﺑﺎزرﺳﯽ،ﺑﺎزرﺳﯽ ﺧﻮدرو ﺑﻪ ﻣﻨﻈﻮر ﮐﺸﻒ ﺟﺮم در ﻧﻈﺎم ﺣﻘﻮﻗﯽ اﯾﺮان .ﻧﺘﺎﯾﺞ ﭘﮋوﻫﺶ ﻧﺸﺎن ﻣﯽ دﻫﺪ ﮐﻪ ﺿﺮورﯾﺴﺖ ﻗﺎﻧﻮن ﮔﺬاران و ﮐﺎرﺷﻨﺎﺳﺎن ﻗﻀﺎﯾﯽ ﻣﻮاردي ﻫﻤﭽﻮن ﺷﻔﺎف ﺳﺎزي ﻣﻔﻬﻮم ﻣﻨﺰل ﯾﺎﻣﮑﺎن ﺧﺼﻮﺻﯽ ، ﻣﻨﻈﻮراز زﻣﺎن ﺷﺐ در ﻣﻮﺿﻮع ﻣﺎده ﻣﻤﻨﻮﻋﯿﺖ ﺑﺎزرﺳﯽ، ﺗﮑﻠﯿﻒ ﺿﺎﺑﻄﯿﻦ در ﺻﻮرت ورود ﻣﺘﻬﻢ ﺑﻪ ﯾﮏ ﻣﮑﺎن ﺧﺼﻮﺻﯽ و ﻣﻨﺰل دوﺳﺘﺎن و ﺷﺨﺺ ﻏﺮﯾﺒﻪ در ﺣﯿﻦ ﻓﺮار، ﺣﻔﻆ ﺣﺮﯾﻢ ﺟﺴﻤﺎﻧﯽ اﻓﺮاد ﺣﺎﺿﺮ در ﻣﻨﺎزل و اﻣﺎﮐﻦ ﺑﻪ ﻫﻨﮕﺎم ﺗﻔﺘﯿﺶ و ﺑﺎزرﺳﯽ ﺑﺪﻧﯽ، ﭼﮕﻮﻧﮕﯽ ﻣﺘﻮﻗﻒ ﻧﻤﻮدن ﺧﻮدروﻫﺎ و وﺳﺎﯾﻞ ﻧﻘﻠﯿﻪ و ﻫﻤﭽﻨﯿﻦ ﺗﻌﻘﯿﺐ وﺳﺎﯾﻞ ﻧﻘﻠﯿﻪ ،ﺟﻮاز ﻧﻈﺮ ﺑﻪ داﺧﻞ ﺧﻮدرو،ﺗﻔﺘﯿﺶ داﺷﺒﻮرد و ﺻﻨﺪوق ﻋﻘﺐ ،ﺗﻌﯿﯿﻦ ﺗﮑﻠﯿﻒ ﻣﺎﻣﻮران ﻧﯿﺮوي اﻧﺘﻈﺎﻣﯽ ﺟﻬﺖ اﯾﺴﺖ و ﺑﺎزرﺳﯽ در ﺷﺐ، در ﻗﺎﻧﻮن آﯾﯿﻦ دادرﺳﯽ ﮐﯿﻔﺮي و... را در اﺻﻼﺣﯿﻪ ﻫﺎي ﺑﻌﺪي آﯾﯿﻦ دادرﺳﯽ ﮐﯿﻔﺮي ﻣﺪﻧﻈﺮ ﻗﺮار دﻫﻨﺪ.

Abstract the purpose of this study is to "investigate the legal void of crime detection in the Iranian legal system". This research is based on the purpose of the problem-oriented application, and the required information is collected by documentary method and analyzed by analytical and descriptive method. The research methodology is a library. In this research, four questions have been raised: suspected legal vacuum, inspection of homes and places, stopping and checking, car inspection and summoning the defendants in order to detect a crime in the Iranian legal system.
