جايگاه حريم خصوصي در واكاوي هاي جرم شناختي با تاكيد بر مكتب اسلامي حقوق جزا

The place of privacy in criminological investigations with emphasis on the Islamic school of criminal law

حريم خصوصي در دنياي امروز علي الخصوص جامعه اسلامي ، از مهمترين ملزومات زندگي انسان و از مباحث مهم علم اخلاق و مكتب اسلام مي باشد.با توجه به تحولات مكاتب حقوق جزا و قرار گرفتن سوژه هاي انساني در معرض پژوهش هاي جرم شناسانه از جمله: جامعه شناسي جنايي و روان شناسي جنايي،امكان نقض حريم خصوصي افراد و در خطر قرار گرفتن نظم عمومي جامعه و خدشه دار شدن اخلاق حسنه وجود دارد.با توجه به اينكه در قانون گذاري ايران به طور مستقل و جداگانه قانوني براي حمايت از حريم خصوصي در واكاوي ها و پژوهش هاي جرم شناسانه وضع نگرديده و صرفا در مقرره هاي متعدد و پراكنده آمده است،به همين علت آگاهي در باب اهميت حريم خصوصي و پيامد هاي ناگوار نقض آن وجود ندارد. در اين نوشتار سعي شده است پس از تعريف مفهوم و چيستي حريم خصوصي،بيان اهميت آن در جوامع امروزي و در قوانين داخلي و سياست جنايي ايران،به جايگاه آن در مستندات فقهي و اسلامي پرداخته شود.

Privacy in today's world, especially in Islamic society, is one of the most important necessities of human life and one of the most important topics
in ethics and the school of Islam . Due to the developments in criminal law schools and the exposure of human subjects to
criminological research, including : criminal sociology and criminal psychology, the possibility of violating the privacy of individuals and
endangering the public order of society and damaging the good morals of existence Has . Considering that the Iranian legislation does
not independently and separately provide a law to protect privacy in criminological investigations and researches
and is only mentioned in numerous and scattered regulations, therefore, awareness of the importance of privacy and
There are no unintended consequences of violating it .In this article, after defining the concept and nature of privacy, expressing
its importance in today's societies and in the domestic laws and criminal policy of Iran, its place in jurisprudential and Islamic documents is discussed .
