چكيده فارسي :
كدخدامنشي به‌عنوان سيستمي براي حل‌وفصل منازعات غالباً در داوري به‌خصوص در حوزه بين‌الملل شناخته مي‌شود. حقوق فرانسه، مهد كدخدامنشي، اين امكان را به طرفين دعوا مي‌دهد كه از قاضي بخواهند اختلافات را كدخدامنشانه رسيدگي كند. در ايران قديم، افراد اختلافات خود را نزد كدخدا مطرح مي‌كردند ولي به‌مرور با روي كار آمدن دولت‌ها، دادگستري‌ها جايگزين شيوه‌هاي سنتي حل‌وفصل اختلافات شدند كه نتيجه آن تلاش طرفين دعوا براي اثبات حق به نفع خود بود؛ درحالي‌كه در شيوه‌هاي سنتي حل اختلاف همچون كدخدامنشي سعي بر حل ريشه مشكل براي رسيدن به آرامشي پايدار است. تلاش سيستم قضايي براي احياي شيوه‌هاي سنتي در قالب شوراهاي حل اختلاف نشان داد كه اين امر به‌صرف تغيير فرد رسيدگي‌كننده و سعي براي سازش محقق نمي‌شود. براي كدخدامنشي بايد سيطره قواعد حقوقي شكسته شود و متوجه شد كه حمايت صرف از حقوقي كه در قانون شناسايي شده است، تنها فصل خصومت مي‌كند والا حل‌وفصل اختلافات به چيزي بيش از رسيدگي به ادله و حكم كردن بر اساس آن نياز دارد. در كدخدامنشي برخلاف قضاوت كه به دنبال محق و محكوم است، بايد به سراغ راهي رفت كه ممكن است حقوقي نباشد اما گره اختلاف را بگشايد. كدخدامنشي نيازمند خلاقيت، آموزش و تجربه است ازاين‌رو بهترين مكان براي توسعه كدخدامنشي همان دادگاه‌هاي قضايي است. مقاله حاضر با اقتباس از حقوق فرانسه، شيوه دادرسي كدخدامنشانه را پيشنهاد مي‌دهد

The Amiable composition is a system for resolving disputes and is recognized in international arbitration. In The French legal system, the judge can be entrusted with a mission of amicable composition by the parties. In ancient Iran, villagers argued with Kadkhoda, but as governments came to power, traditional methods of resolving disputes replaced government judicial systems, resulting in litigants trying to prove themselves right;Whereas in traditional methods of resolving disputes, such as an Amiable composition, the dispute was tried to be completely resolved in order to achieve eternal peace. Unfortunately, the dispute resolution councils could not reach a compromise In order to achieve an amicable composition, the rule of law must be abandoned He realized that guaranteeing legal rights was not the only way to resolve disputes. Contrary to the judgment that seeks the winner and the loser, in an amicable composition one must look for a way that may not be legal but resolves the dispute. An amicable composition requires creativity, training and experience, so the best place to develop it is the courts. This article, based on French law, suggests a mission of amicable composition.
