تطبيق نظريه عدالت از ديدگاه صدر و نوزيك

Comparative Study of Justice Theory; Sadr vs. Nozick

در اين مقاله نظريه عدالت را از ديدگاه سيد محمدباقر صدر و رابرت نوزيك تحليل و مقايسه مي‌كنيم. نظريه عدالت از ديدگاه اين دو انديشمند به طور جداگانه در مقاله هاي متعددي بحث شده است. نوآوري اين مقاله مقايسه و تحليل ديدگاه‌هاي اين دو تن درباره نظريه عدالت از دريچۀ نگاه به مبنا و مفهوم حق است. مبناي اين مقايسه، حضور مقولۀ مشترك «حق» ولي با مفاهيم و مباني متفاوت در انديشۀ صدر و نوزيك است. نظريۀ عدالت استحقاقي نوزيك بر مفهوم حق طبيعي جان لاك و مبناي آزادي فردي پايه‌‌گذاري شده است. نظريه عدالت صدر بر مفهوم حق استخلاف الهي و آزادي محدود فردي استوار است. در اين مقاله در پرتو اين مقولۀ مشترك ولي با مفهوم و مبناي مختلف، به تحليل تفاوت ديدگاه‌ اين دو تن به مسائل نظريۀ عدالت هم چون منشأ حقوق فردي، آزادي، فرآيندانگاري، غايت‌نگري، الگومندي، مالكيت و وظايف دولت مي پردازيم. روش پژوهش، تحليلي و متكي به اسناد و آثار اين دو انديشمند است.

In this paper, justice theory is discussed and compared from two philosophers’ points of view; Mohammad Baqir Sadr and Robert Nozick. The conceptual framework of this comparison is based on the categories which these two philosophers have in common. Nozick’s pure procedural theory of justice consists of two main concepts; original acquisition of holdings and transfer of holdings. Sadr’s end-state theory of justice also consists of two concepts; pre-production distribution and post-production distribution. Nozick’s concept of original acquisition of holdings and sadr’s concept of pre-production distribution, both discuss how man can acquire natural resources, but based on different conception of right. According to different perceptions of right, these two theories of justice are compared. Therefore this paper aims at analyzing the differences of these two theories of justice according to the mentioned conceptual frameworks, discussing topics such as the origin of right, teleological justice, property rights and government duties.
