تعارض اقرار با امارات قضايي در آراء فقها و حقوق كيفري ايران

Contradiction of Confession with Judicial Indication (Amāra) in Views of Jurists and Iranian Criminal law

يكي از مباحث پر اهميت در ادله اثبات دعوا، مسأله طريقيت و موضوعيت اقرار است كه در اين پژوهش از حيث كيفري مورد توجه قرار گرفته است. بدين جهت، در فرض موضوعيت، اقرار بنفسه واجد ارزش است و لذا به محض اقرار مقر، حكم در مورد او اجرا مي‌شود. ولي در فرض طريقيت، در صورتي واجد ارزش است كه موجب كشف واقع شود؛ لذا قاضي با عدم اقناع مي‌تواند اقرار را كان لم يكن بداند. نظر فقها در مورد موضوع تحقيق در بررسي تعارض دو طريق و يا نحوه استنباط از متن روايت (دو اقرار به يك قتل) و يا تصريح به طريقيت و يا موضوعيت قابل كشف است. گفتني است قوانين كيفري عليرغم ابتنا بر فقه، صراحت نداشته و بعضا متعارض جلوه مي‌كنند. آنچنان كه در اين مقاله به اثبات رسيده است طريقيت اقرار با مباني فقهي و اصول حقوقي كاملا سازگار است.

One of the most important topics in the evidence of litigation, whether it is fundamental or not, is confession, which has been considered in criminal terms in this research. Therefore, based on being fundamental, confession itself is important and with confession, the verdict is approved. But if the confession is unfounded, it matters if it clarifies an issue, and if the judge is not convinced, the confession does not matter. The opinion of the jurists on the research topic can be discovered by examining two methods or the way they interpret the narration (two confessions to a murder) or specifying whether the confession is fundamental or not. It should be noted that the position of criminal law, despite its reliance on jurisprudence, is not clear and is sometimes contradictory. As it has been proved in this article, the method of confession is more in line with jurisprudential and legal principles.
