Cyber identity: The Password for Assigning Criminal Responsibility

در عصر حاضر با پيشرفت تكنولوژي و وسايل ارتباطي، شاهد حضور چشمگير كاربران در فضاي مجازي هستيم. فضايي رمز‌آلود و بي‌انتها كه با ويژگي‌هاي منحصربه‌فرد مي‌تواند هر سليقه‌اي را به خود جذب كند. افزايش ارتكاب جرائم سايبري بيانگر علاقه خاص مجرمان به اين ويژگي‌ها از جمله گمنامي و حضور قربانيان بي‌اطلاع است. جوامع بشري در استفاده از مجازات به عنوان اولين وسيله دفاعي خود در برابر بزهكاران سايبري با چالش عدم شناسايي مجرم روبه‌رو مي‌شوند. اما واقعيت اين است كه مجرمان سايبري از فضاي حقيقي پا به اين فضا گذاشته‌اند و هويتي نامعلوم ندارند. دستگاه عدالت كيفري با كمك تكنولوژي مي‌تواند ردپاي به‌جامانده از متهم را دنبال كند و با دستيابي به هويت سايبري و مرتبط كردن آن با اطلاعات موجود از نحوه دستيابي متهم به اينترنت، هويت حقوقي او را در فضاي حقيقي شناسايي و مسئوليت كيفري رفتار مجرمانه را بر او بار كند. رمزگشايي از ارتباط ميان تكنولوژي و حقوق كيفري در اولين گام از فرايند رسيدگي به جرم سايبري يعني شناسايي متهم با كمك پروتكل اينترنت يا همان IP امكان‌پذير مي‌شود.

In the present era, with the advancement of technology and communication devices, we are witnessing a significant presence of users in cyberspace. A mysterious and endless space with unique features that can appeal to any taste. The increase in cybercrime reflects the special interests of criminals in these features, which include, anonymity and the presence of uninformed victims. In using punishment as their first means of defense against cybercriminals, human societies face the challenge of not identifying the culprit. However, the fact is that cybercriminals have stepped into the realm of space and have no known identity. With the help of technology, the criminal justice system can track the accused's left footprint and, by obtaining a cyber identity and linking it to the available information on how the accused accesses the Internet, it identifies their legal identity in real space, and so imposes criminal responsibility on them for criminal behavior. Decryption of the connection between technology and criminal law is possible in the first step of the cybercrime investigation process, in other words, the accused can be identified with the help of the Internet Protocol or IP.
