پيشرفت‌هاي روزافزون محيط اينترنت سبب پيدايش موضوعات بديع در ارتباط با حقوق IT شده است؛ كه ايجاد نام دامنه‌هاي اينترنتي از جملة آن مي‌باشد. نام دامنه‌هاي اينترنتي ابعاد حقوقي گسترده‌اي دارند كه نيازمند حمايت مقنن و پشتوانة قانوني است. درخور توجه است كه اساساً نام‌هاي دامنه از مصاديق برجستة اموال كنوني و مورد حمايت اكيد قوانين ايران قرار خواهد گرفت. شايستة بيان است كه در قانون تجارت الكترونيك جمهوري اسلامي ايران به نام دامنه‌ها اشارة مختصري شده است. لكن تاكنون در زمينه­ي تبيين حقوق دارندگان نام­هاي­ دامنه و ثبت آن، خلأ قانوني وجود دارد كه نيازمند اصلاح قانون نامبرده يا تدوين قانون مناسب و جامعي است. از اين رو پژوهش حاضر با نگاهي تطبيقي به حقوق فرانسه به بررسي ضرورت ثبت نام ­هاي دامنه اينترنتي پرداخته است. پژوهش پيش رو در مبحث ادبيات حقوقي اموال و اقسام آن رويكردي به نظرات استاد حقوق، استاد جعفري لنگرودي داشته و از اين روي به غناي بحث افزوده شده است.

The increasing advancement of the internet has led to the advent of innovative issues in the field of IT rights, and the creation of an internet domain name is one of them. An Internet domain name includes wide expanded legal dimensions, which need the support of the legislator and legal support. It should be noted that the domain names can be highlighted examples of the current properties and would be supported by Iran's law. It should be mentioned that the domain name is shortly discussed in the electronic commerce law of the Islamic Republic of Iran. However, there are legal gaps still in the field of discrimination of the right of holders of domain names and their registration. The said law should be amended or comprehensive, and appropriate law should be codified. Hence, the present study has made a comparative investigation on the French Law to analyze the necessity of registration of internet domain names. This study has applied the opinions of Jafari Langarudi in the field of legal literature of properties and its types and this has increased the richness of this study.
