The Role of Customary International Law in Direct Support of Environment in Armed Conflicts

عليرغم اصل عدم توسل به زور و تحريم جنگ در روابط بين‌المللي، همچنان در شكل مجاز آن مانند توسل به دفاع مشروع، انسان‌هاي زيادي كشته و از اين رهگذر محيط زيست به شدت آسيب مي‌بيند. حمله در زمان جنگ عليه اهداف نظامي و غيرنظامي، غالباً بر محيط‌زيست تاثير گذار بوده و از طرفي گسترش سلاح‌هاي جديد مانند سلاح‌هاي هسته‌اي، خطرات جدي را براي محيط‌زيست به ارمغان آورده است. موارد اخير، حساسيت و نگراني جامعه‌ي بين‌المللي را نسبت به وقوع صدمات زيست‌محيطي در زمان وقوع مخاصمات مسلحانه برانگيخته و ذهن حقوق‌دانان را به خود معطوف داشته است. در حال حاضر نيز با توجه به اهميت موضوع، كميسيون حقوق بين‌الملل سازمان ملل متحد، بحث حمايت از محيط‌زيست در مخاصمات مسلحانه را در دستور كار خود قرار داده است، تا در پرتو تدوين و توسعه‌ي قواعد عرفي به حمايت از محيط‌زيست بپردازد. از آن‌جا كه مطابق بند 1 ماده‌ي 38 اساسنامه‌ي ديوان بين‌المللي دادگستري، يكي از منابع حقوق، عرف بين المللي است، بايد توجه داشت كه محيط‌زيست علاوه بر مقررات قراردادي، توسط قواعد نانوشته حقوق بين‌الملل عرفي مورد حمايت واقع مي‌شود. اين مقاله در صدد است تا نقش و راهكارهاي حقوق بين‌الملل عرفي را در حمايت مستقيم از محيط زيست در زمان مخاصمات مسلحانه مورد بررسي قرار دهد.

Despite the principle of non-use of force and sanction of war in international relations, as well as its use as a legitimate form of self-defense, still many people have been killed and severely damaged the environment in this way. Attacks against military targets and civilians in time of war, often impact on the environment and also the development of new weapons such as nuclear weapons, has brought serious threats to the environment. Recent cases, sensitivity and concern for the international community to the environmental damage in the event of armed conflict motivated and drew the attention of lawyers. Given the importance of this issue, the International Law Commission of the United Nations has put the protection of the environment in armed conflict on its agenda, in the light of the development of customary rules to protect their environment. Because in accordance with paragraph 1 of Article 38 of the Statute of the International Court of Justice, one of the sources of international law is international custom, it should be noted that the environment in addition to the contractual provisions is also supported by the unwritten rules of customary international law. Therefore, this study seeks to review the role and strategies of customary international law in direct support of the environment in time of armed conflict.
