تعهد دولت‌ها به ايمن و پايدارسازي سكونت‌گاه‌ها در مقابله با تغييرات اقليمي در چارچوب حقوق بين‌الملل

The commitment of states to the safty and sustainablility of settlements in the safe of climate change in the context of international law

پژوهش حاضر به موضوع تعهد دولت‌ها به ايمن و پايدارسازي سكونت‌گاه‌هاي انساني در مقابله با تغييرات اقليمي در چارچوب حقوق بين‌الملل مي‌پردازد. هدف از نگارش اين پژوهش تبيين تعهدات حقوقي دولت‌ها به ايمن و پايدارسازي سكونت‌گاه‌ها در مقابله با تغييرات اقليمي در چارچوب حقوق بين‌الملل است. اين پژوهش به صورت كيفي، تحليلي، توصيفي و به صورت كتابخانه‌اي انجام گرفته است. تغييرات اقليمي از جمله عواملي است كه از دهه ها قبل پايدارسازي سكونت‌گاه‌ها را با چالش رو‌به‌رو ساخته و خسارات بسياري را به محيط‌زيست بشر وارد آورده است. بنابراين دولت ها در قالب معاهدات و كنوانسيون‌هاي زيست‌محيطي سعي در كنترل اين پديده نموده‌اند. گرچه كنوانسيون‌ها و اسناد حقوقي بسياري به تعهدات دولت‌ها به پايداري سكونت‌گاه‌ها در مقابله با تغييرات اقليمي و همچنين كاهش بلاياي طبيعي كه همگي سكونت‌گاه‌هاي انساني را دچار چالش مي‌سازد، تاكيد نموده‌اند و هر يك از دولت‌هاي عضو تعهداتي را جهت مقابله و كنترل تغييرات اقليمي و كاهش انتشار گازهاي گلخانه‌اي و از طرفي سازگاري محيط‌زيست بشري با پديده تغييرات اقليمي همچون ايمن‌سازي سكونت‌گاه‌ها و اماكن بشري عهده‌دار شدند، اما به دليل ويژگي غيرالزام آوري‌شان چندان مورد توجه دولت‌ها نيستند. اما در هر صورت مي توانند به عنوان سازوكاري موثر در كنترل تغييرات اقليمي و ايمن نمودن سكونت‌گاه‌ها مثمر ثمر باشند.

The present study addresses the commitment of states to the safety and sustainability of human settlements in the face of climate change within the framework of international law. The purpose of writing this study is to explain the legal obligations of states to the safety and sustainability of settlements in the face of climate change in the framework of international law. This research has been done qualitatively, analytically, descriptively and as a library. Climate change is one of the factors that has made the stabilization of settlements a challenge for decades and has caused a lot of damage to the human environment. Therefore, states have tried to control this phenomenon in the form of environmental treaties and conventions. However, many conventions and legal instruments emphasize the commitment of states to the sustainability of settlements in the face of climate change, as well as the reduction of natural disasters, all of which affect human settlements, and each member state has obligations to combat and control climate change. They have been responsible for reducing greenhouse gas emissions and adapting the human environment to the phenomenon of climate change, such as securing human settlements and places, but due to their non-binding nature, they are not much considered by states. But in any case, they can be effective as an effective mechanism in controlling climate change and securing settlements.
