ﺗﺄﺛﯿﺮ ﺷﻨﺎﺳﺎﯾﯽ و ﺑﻪ ﮐﺎرﮔﯿﺮي ﻗﺎﻋﺪهﻫﺎي ﻧﻮي ﻓﻘﻬﯽ، در ﺗﻮاﻧﻤﻨﺪ ﺳﺎزي ﺑﯿﺶ از ﭘﯿﺶ ﻓﻘﻪ ﺷﯿﻌﻪ، در ﺟﺮﯾﺎن اﺳﺘﻨﺒﺎط و ﺗﺤﻠﯿﻞ اﺣﮑﺎم ﻓﻘﻬﯽ و ﺑﻪ ﺗﺒﻊ آن، در ﮔﺴـﺘﺮش و ﺗﻌﺎﻟﯽ ﻓﻘﻪ ﺷـﯿﻌﻪ و ﻧﯿﺰ اﻓﺰاﯾﺶ ﺗﻮان و ﮐﺎرآﻣﺪي آن در ﺣﻮزهي ﭘﺎﺳــﺨﮕﻮﯾﯽ ﺑﻪ ﻧﯿﺎزﻫﺎ و ﻣﺴــﺎﺋﻞ ﻧﻮﯾﻦ ﺟﺎﻣﻌﻪ، اﻧﮑﺎر ﻧﺎﭘﺬﯾﺮ اﺳــﺖ. اﻧﺼــﺎف و ﻋﺪاﻟﺖ، ﯾﮑﯽ از ﻣﺪﺧﻞﻫﺎي ﻣﻬﻢ در اﺑﻮاب ﻣﺘﻌﺪد داﻧﺶ ﻓﻘﻪ ا ﺳﺖ ﮐﻪ ﺷﻤﺎر ﭼ ﺸﻤﮕﯿﺮي از اﺣﮑﺎم ﻓﻘﻬﯽ، ﺑﻪ آن، ﻣ ﺸﺮوط و ﯾﺎ ﻣﻌﻄﻮف ا ﺳﺖ و اﻣﺮوزه، در ادﺑﯿﺎت ﻓﻘﻪ، از ﻣﻨﻈﺮﻫﺎي ﻣﺨﺘﻠﻒ دروﻧﯽ و ﺑﯿﺮوﻧﯽ ﺑﻪ آن ﻧﮕﺮﯾ ﺴﺘﻪ ﻣﯽ ﺷﻮد و ﺑﺎ روﯾﮑﺮدﻫﺎي ﻣﺘﻔﺎوت، درﺑﺎرهي آن، ﺳﺨﻦ ﻣﯽرود؛ از اﯾﻦ رو، ﻧﻮ ﺷﺘﺎر ﺣﺎ ﺿﺮ ﻣﯽﮐﻮ ﺷﺪ، ﺑﺎ ﻫﺪف ﺷﻨﺎ ﺳﺎﺋﯽ ﻗﺎﻋﺪهي اﻧ ﺼﺎف ﮐﻪ اﻟﺒﺘﻪ، ادﺑﯿﺎت ﻓﻘﻪ ﺷﯿﻌﻪ ﺑﺎ آن، آﺷﻨﺎﯾﯽ دﯾﺮﯾﻦ دارد و در ﻻ ﺑﻪ ﻻي اﻧﺪﯾﺸﻪﻫﺎ و ﻧﻮﺷﺘﻪﻫﺎي ﻓﻘﻬﯽ ﻓﻘﯿﻬﺎن ﺷﯿﻌﻪ، ﺟﺎري و ﻣﺴـﺘﻮر اﺳﺖ، ﻣﺒﺎﻧﯽ اﺛﺒﺎت ﭘﺬﯾﺮي ﻧﮕﺮهي ﻗﺎﻋﺪه ﻧﮕﺎري اﻧﺼــﺎف را ﺑﯿﺎن دارد و ﻧﻤﻮﻧﻪﻫﺎﯾﯽ از ﮐﺎرﺑﺮد آن را در ادﺑﯿﺎت ﻓﻘﻪ ﺷــﯿﻌﻪ، ﻧﻤﺎﯾﺎن ﺳﺎزد.

The effect of identifying and applying the new rules of jurisprudence, in empowering Shia jurisprudence more than ever before, during the inference and analysis of jurisprudential rules and consequently, in the expansion and excellence of Shia jurisprudence and also increasing its power and efficiency in the field of responding to needs an‎d the new issues of society are undeniable. Fairness and justice is one of the important entries in the many chapters of jurisprudence, which a significant number of jurisprudential rules are conditional or focused on it and today, in jurisprudence literature, it is viewed from different internal and external perspectives. an‎d it is talked about with different approaches; Therefore, the present article tries to identify the rule of fairness with which, of course, the literature of Shia jurisprudence is long familiar and is current and prevalent alongside the ideas and jurisprudential writings of Shia jurists. It expresses the foundations of provability of the normative view of fairness and shows examples of its application in the literature of Shia jurisprudence
