بررسي تطبيقي سقط جنين در نظام كيفري ايران و سوئد

A Comparative Study of Abortion in the Penal System of Iran and Sweden

مسئلة باروري همواره در هر كدام از جوامع متمدن بشري مورد بحث بوده و پيامدهايي نيز داشته است كه يكي از اين موارد سقط جنين مي‌باشد. سوال پژوهش اين است كه سقط جنين در دو كشور ايران و سوئد از بعد كيفري چگونه است؟ فرضيه تحقيق اين است كه قانونگذار جمهوري اسلامي ايران و سوئد، جنين انسان را موجودي داراي شخصيت انساني و قابل تكريم و حمايت مي‌داند كه مانند ساير انسان‌ها داراي حقوقي از جمله حق حيات و سلامت است بدين‌ترتيب، مقالة حاضر درصدد است به شيوة تطبيقي و با استفاده از روش مطالعة اسنادي و كتابخانه‌اي، به مقايسه نظام حقوقي ايران و سوئد در‌خصوص مسئله سقط جنين بپردازد و هدف اين است كه درنهايت، به تفاوت‌هاي كمي و كيفي قوانين جزايي اين دو كشور پي برده شود. نتايج تحقيق نشان مي دهد كه سقط جنين در حقوق ايران و سوئد جرم بوده و فرد بزهكار بايستي متحمل كيفر گردد.

The issue of fertility has always been debated in every civilized human society and has had consequences, one of which is abortion. The question is what is the criminal status of abortion in Iran and Sweden? The research hypothesis is that the legislator of the Islamic Republic of Iran and Sweden considers the human fetus to be a human being with a respectable and protective personality who, like other human beings, has rights such as the right to life and health. Using the method of documentary and library study, the present article seeks to compare the legal system of Iran and Sweden in the field of abortion and the aim is to finally understand the quantitative and qualitative differences between the criminal laws of the two countries. The results show that abortion is a crime in Iranian and Swedish law and the offender must be punished.
