چكيده فارسي :
محمد شحرور نوانديش معاصر اهل سوريه در مهم ترين اثر خود الكتاب و القرآن رؤيه جديده مسائل و نظريات جديدي در حوزه علوم اسلامي مطرح نموده است. وي با نقد فقه سنّتي نظريه حدود خود را تحت دو اصطلاح جديد «إستقامت» و «حنيفي بودن» توضيح داده و بر مبناي آن آراي بديعي در زمينه احكام ارائه داده است. شحرور بر اين باور است كه انسان و موجودات عالم ميل به تغيير و انحراف دارند (حنيفي بودن) و نيازمند هستند كه خداوند آن ها را به صراط مستقيم هدايت كند(استقامت). آراي فقهي او علاوه بر كتاب ياد‌شده در كتاب نحو أصول جديده للفقه الإسلامي فقه المرأه آمده است. اين مقاله با روش توصيفي-تحليلي در پي واكاوي و تحليل نظريه حدود وي براي دست يابي به پاسخ اين سوال است: محمد شحرور نظريه فقهي حدود را چرا و چگونه مطرح كرده است؟ و نظريه فقهي شحرور چگونه قابل تحليل و نقد است؟
نتيجه پژوهش نشان داد كه نظريه حدود شحرور متأثر از ذهن رياضي وي بوده كه با مدد گرفتن از مبحث توابع رياضي و هندسي امكان انحناء از صراط مستقيم را در شش حالت مي داند و انواع حدود شريعت اسلام را در همان چارچوب توضيح مي دهد. شحرور قائل است كه آيات حدود، اساس تشريع و آيات شعائر، اساس تقواي فردي است. وي براي تشريع در دوره معاصر شروط دوازده گانه اي قائل است مانند: فهم زبان عربي، در نظر گرفتن زمينه علميِ عصر حاضر، قوانين اقتصادي و اجتماعي معاصر و... . وي معتقد است براي فهم مشكلات فقه اسلامي موروث كه با دانش و شرايط قرن حاضر متناسب نيست، بايد با شناخت عوامل اين بحران چاره جويي كرد

In his most important work, Al-Kitab wa Al-Quran, Mohammad Shahrour, a contemporary modernist from Syria, has presented new issues and theories in the field of Islamic sciences. By criticizing traditional jurisprudence, he has explained his theory of limits under two new terms, "endurance" and "being a Hanifi", and based on that, he has presented novel opinions in the field of rulings. Shahrour believes that human beings and beings in the universe tend to change and deviate (being Hanifi) and need God to guide them to the straight path (endurance). In addition to the above-mentioned book, his jurisprudence opinions are mentioned in the book "Syntax of New Principles for Islamic Jurisprudence". This article seeks to analyze and analyze his theory of limits by descriptive-analytical method to obtain the answer to this question: Why and how did Mohammad Shahrour introduce the jurisprudence theory of limits?
The result of the research showed that the theory of limits of consciousness is influenced by his mathematical mind, which with the help of mathematical and geometric functions considers the possibility of curvature of the straight path in six states and explains the types of limits of Islamic law in the same framework. Shahrour believes that the verses of Hudud are the basis of legislation and the verses of rituals are the basis of individual piety. He considers twelve conditions for legislation in the contemporary period, such as: understanding the Arabic language, considering the scientific background of the present age, contemporary economic and social laws, and so on. He believes that in order to understand the problems of inherited Islamic jurisprudence, which is not appropriate to the knowledge and conditions of the present century, it is necessary to find a solution by recognizing the causes of this crisis.
