لزوم نگارش مبايعه‌نامه املاك توسط وكيل دادگستري و سردفتر اسناد رسمي به جهت پيشگيري از دعاوي ملكي

Necessity of Writing the Bill of Housing Sale by a Lawyer and Notary Public in order to Prevent Actions for the Object of Sale

يكي از دعاوي مهمْ دعاوي ملكيِ ناشي از عدم تنظيم صحيح عقد بيع، به‌دست افراد عادي و مشاوران املاك است كه با اتخاذ تدابير بازدارنده، مي‌توان از حجم پرونده‌ها در اين حوزه كاست. متأسفانه قانون‌گذار با وضع قوانين ناكارآمد و بدون توجه به آثارِ زيان‌بارِ تنظيمِ مبايعه‌نامه توسط افراد فاقد دانش حقوقي، زمينۀ نقض حقوق شهروندان و افزايش آمار دعاوي ملكي را فراهم كرده‌است. لذا پرسش اساسيِ اين پژوهش اين است كه تنظيم عقد بيع و نگارش صحيح مبايعه توسط كارشناسان حقوقي، تا چه حدي از بروز اختلافات ملكي پيش‌گيري مي‌كند؟ با رويكردي توصيفي ـ تحليلي، اين مقاله براي پيش‌گيري از وقوع دعاوي و اختلافات ملكي، در پي ارائۀ راهبردهاي كارآمدي است كه ازطريق الزام طرفينِ عقد بيع به مراجعه به كارشناسان حقوقي (نظير وكلا و سردفتران اسناد رسمي)، به‌منظور نگارش مبايعه‌نامه انجام مي‌پذيرد. نتايج پژوهش نشان مي‌دهد بسياري از دعاوي ملكيْ ناشي از عدم رعايت اصول و قواعد حقوقي هستند و چنانچه نگارش مبايعه‌نامه به‌دستِ افرادِ متخصصِ حقوقي صورت گيرد، دانش حقوقي و قضايي آنان باعث پيش‌گيري از اين دعاوي يا كاهش آن‌ها مي‌شود و مشاورانِ مسكن نيز، مطابق با قوانين تجارت، صرفاً نقش واسطه‌گري و دلالي دارند و صلاحيت نگارش مبايعه‌نامه را ندارند.

One of the most important lawsuits is actions for the object of sale, which is caused by the lack of proper regulation of the contract of sale by housing consultants, and can be reduced by taking preventive measures. Unfortunately, the legislature has provided the ground for violating the rights of citizens and increasing the number of cases by enacting ineffective laws without regard to the harmful effects of the writing of the bill of sale by persons without legal knowledge. Therefore, the main question of the research is to what extent does the preparation of the contract of sale and its correct writing by legal experts prevent the occurrence of disputes? With a descriptive-analytical approach, the paper seeks to provide effective strategies for preventing property disputes by requiring the parties to refer to legal experts to write bill of sale. The results of the research show that many cases are caused by non-observance of legal rules, and if the writing of sale contract is done by legal experts, it will prevent or reduce these lawsuits. According to commercial law, housing consultants have only the role of mediator and do not have the authority to write a bill of sale.
