چكيده فارسي :
هدف: يكي از تفكرات متداول بين زنان اين است كه تمام سختي‌ها، از جمله: سختي فرزندداري، درد زايمان و بارداري مربوط به زنان است؛ اين مقاله در پي راستي‌آزمايي چنين تفكري، به بررسي امور عبادي، مدني و جزايي در خصوص زنان پرداخته است. روش: براي نيل به اين هدف، مصاديقي از هر موضوع بنا به درجۀ اهميت آن، انتخاب و پس از بيان ادلّۀ فقهي، حكمت آنها بررسي شد و در تمام مراحل به دنبال پاسخگويي به اين سؤال بود كه وجود احكام خاص در زنان، به چه علت بوده است. آيا مي‌تواند به علت نوعي ترحّم بر آنان باشد كه در اين صورت از آن فروتري و ضعف زنان منتج شود؟ يافته‌ها: با بررسي نمونه‌هاي مختلف، ديده شد كه در مقابل سختي‌ها، معافيتهايي در احكام خاص زنان نهاده شده كه انگيزه‌اي وراي تحقير بوده است؛ به طوري كه وجود تبعيض مثبت در قوانين بين‌المللي، امروزه معادلي كوچك از اين امتيازات در قوانين اسلامي است كه وضع آنها حكايت از درماندگي جامعۀ غرب در ايجاد تساوي زنان و مردان دارد. نتيجه‌گيري: قرار دادن اين امتيازات در زنان، در عين حال كه نوعي تسهيل و تخفيف بوده است و نشان از وجود فضل و رحمت الهي دارد؛ از اين لحاظ حاِئز اهميت است كه اين ميزان توجه و دقت نظر در وضع احكام خاص زنان، با توجه به خصوصيات روحي آنان، به واقع نشان از خالقي بي‌نظير دارد.

Objectives: One of the common thoughts among women is that all the difficulties are related to the difficulty of having children, labor pains and pregnancy. This article examines the religious, civil and criminal affairs of women in order to verify such attitude. Method: In order to achieve this goal, we selected cases from each of them as a case study according to their degree of importance, and then after stating the jurisprudential arguments, we examined their wisdom and in all stages, it sought to answer the question that there are special rules in Women, what was the reason? Could it be due to a kind of pity for them, in which case it would result in the humility and weakness of women? Results : Examining various cases, it was observed that in the face of hardships, exemptions have been introduced in the special sentences of women, which was a motive beyond humiliation, so that the existence of positive discrimination in international law, today is a small equivalent of these privileges. It is in Islamic law that their status is a sign of the helplessness of Western society in creating equality between men and women.Conclusion: Putting these privileges in women, at the same time, has been a kind of facilitation and discount and shows the existence of divine grace and mercy. However, the important point here was that this level of attention and attention to the setting of special rules for women according to their spiritual characteristics really shows a unique creator.
