Supportive Arrangements of Religious Tourists in the Global Documents

گردشگر مذهبي يكي از متداولترين انواع گردشگري است، چرا كه امروزه بيشتر مردمان جهان يك آئين اعتقاد دارند همين امر باعث ايجاد گردشگري مذهبي در سطح جهان بصورت گسترده شده است؛ از طرفي اين نوع از گردشگران در معرض خطر بيشتري نسبت به ديگر انواع گردشگران مي باشند، كه اين امر نشات گرفته از باورهاي مذهبي آنان بوده، آنچنان كه بعضا علاوه بر مال، جان آنان نيز به مخاطره مي افتد. بنابراين ما درصدديم بدانيم چه ترتيبات حمايتي از اين نوع گردشگران در عرصه بين الملل در قالب اسناد وجود دارد. آيا اگر حقوق مربوط به گردشگر مذهبي تضييع شود، حقوق بين‌الملل و اسناد جهاني مي توانند به كمك آنان آمده و از آنان حمايت كنند؟ بنابراين هدف و انگيزه ما از اين پژوهش بررسي و شناخت اسناد كاربردي جهاني به منظور مقابله با تضييع حقوق گردشگر مذهبي، تا با بكارگيري مناسب آنان نزد مراجع قضايي و شبه قضايي منطقه اي و بين المللي در بدو امر موجبات پيشگيري و در مراحل بعدي نيز احقاق حق نسبت به حقوق تضييع شده آنان گردد. روش تحقيق در اين پژوهش به صورت توصيفي تحليلي است، نتايج تحقيق نيز نشان داد كه اسناد مختلف در عرصه بين الملل وجود دارد؛ كه قطعا تاثير مناسبي دركاهش تضييع حقوق گردشگرمذهبي مي تواند، داشته باشد. كشورها با استفاده از اسناد عام و خاص قادرند، بسياري از تنش‌هاي سياسي، اقتصادي اجتماعي را در جهان كاهش دهند. از طرف ديگر با شناخت اسناد حمايتي دولتمردان شخص گردشگرقادر است، درپي حقوق تضييع شده و همچنين خواستار جبران خسارات گردند.

Religious tourism is one of the most common types of tourism because nowadays most people in the world believe in one religion, and this has led to establishing religious tourism around the world; On the other hand, this type of tourism is more at risk than other ones which are due to the religious beliefs, so that sometimes the tourists’ properties and lives are endangered. Therefore, we seek to find out what supporting services for this type of tourist exist in the form of documents internationally. Can international laws and global documents help and support them if their rights as religious tourists are violated? Therefore, the purpose and motivation of this study were to study and recognize the practical documents of the world to deal with the violation of the rights of religious tourists so that they can be properly used by regional and international judicial and quasi-judicial authorities in the first place to prevent and later to realize the rights concerning the tourists’ violated rights. The research method is descriptive-analytical. The research results showed that there are various documents in the international arena; which can certainly have a positive effect on reducing the violation related to religious tourism rights. Countries can reduce many of the world’s political, economic, and social tensions by using general and specific documents. On the other hand, by recognizing the supportive documents of the government officials, the tourists can seek the rights that have been violated and also demand compensation.
