An approach to the legislative challenges in the penal system in the field of military shooting

جرايم مرتبط با پرسنل نيروهاي مسلح طبع و ذات متفاوتي نسبت به جرايم ساير افراد داشته و اين طبع و ذات متفاوت و منحصر به فرد را بايد در بررسي و تجزيه و تحليل جرايم آن ها در نظر داشت. بررسي قوانين و مقررات موجود پيرامون تيراندازي نظاميان بيانگر آن است كه چالش هاي مختلفي در نظام كيفري تقنيني پيرامون اينگونه جرايم وجود دارد كه اين امر كاركرد مثبت و منسجم قوانين و مقررات را تحت الشعاع قرار داده است. دستيابي به شناخت جامع و كاملي از موضوع مقررات تيراندازي نيروهاي مسلح، در گرو تبيين دقيق و جامع مباني اين قبيل قوانين و مقررات و چالش هاي موجود در زمينه تقنين و جرم انگاري آن ها مي باشد. براين اساس و بر پايه اين هدف، در اين مقاله، بر اساس روش توصيفي مباني اين گونه قوانين و مقررات و چالش هاي موجود در حوزه تقنين و جرم انگاري را مورد نقد و بررسي قرار مي دهيم.

Crimes related to the personnel of the Armed Forces have a different nature and nature than the crimes of other people, and this different and unique nature and nature should be considered in the study and analysis of their crimes. Examining the existing laws and regulations regarding military shooting indicates that there are various challenges in the legislative penal system regarding such crimes, which has overshadowed the positive and coherent functioning of laws and regulations. Achieving a comprehensive and complete knowledge of the subject of the rules of shooting of the armed forces depends on a precise and comprehensive explanation of the principles of such laws and regulations and the challenges in the field of their legislation and criminalization. Accordingly, in this article, we review the foundations of such laws and regulations and the challenges in the field of legislation and criminalization.
