Validation of Investigative Officers' Actions in Judicial Decisions (Case Study: South Khorasan Province)

ﮐﺎرآﮔﺎﻫﺎن و اﻓﺴﺮان ﺗﺤﻘﯿﻖ ﭘﻠﯿﺲ آﮔﺎﻫﯽ ﺑﻪ ﻋﻨﻮان ﯾﮏ ﭘﻠﯿﺲ ﻋﻠﻤﯽ-ﺗﺨﺼﺼﯽ در ﺑﺮﺧﻮرد ﺑﺎ ﺟﺮم و ﻣﺠﺮم ﺑﻪ ﻧﺴﺒﺖ، ﻧﻘﺶ ﺑﺮﺟﺴﺘﻪ ﺗﺮي دارﻧﺪ. اﯾﻦ ﻣﻬﻢ زﻣﺎﻧﯽ ﺑﯿﺸﺘﺮ ﻧﻤﺎﯾﺎن ﻣﯽ ﺷﻮد ﮐﻪ ﺑﺎزﭘﺮس دادرس ﮐﯿﻔﺮي ﺑﺎ ﺗﻮﺟﻪ ﺑﻪ ﮔﺰارش ﻫﺎي واﺻﻠﻪ ﺗﻮﺳﻂ اﯾﻦ دﺳﺘﻪ از ﺿﺎﺑﻄﺎن ﺑﻪ ﺻﺪور رأي ﻣﺒﺎدرت ﻣﯽ ﮐﻨﺪ؛ ﺑﻨﺎﺑﺮاﯾﻦ ﺑﺮاي ﻣﻌﺘﺒﺮ ﺑﻮدن ادﻟﮥ ﺟﻤﻊ آوري ﺷﺪه ﺗﻮﺳﻂ ﺿﺎﺑﻄﯿﻦ ﻋﻼوه ﺑﺮ اﯾﻨﮑﻪ ﺿﺎﺑﻄﯿﻦ ﻣﯽ ﺑﺎﯾﺴﺖ ﻣﻮرد اﻋﺘﻤﺎد و وﺛﻮق ﻣﻘﺎم ﻗﻀﺎﯾﯽ ﺑﺎﺷﻨﺪ، ارزﯾﺎﺑﯽ و ﺗﺄﯾﯿﺪ اﻗﺪاﻣﺎت ﺻﻮرت ﮔﺮﻓﺘﻪ در راﺳﺘﺎي ﺟﻤﻊ آوري دﻻﯾﻞ و ﻣﺪارك ﺗﻮﺳﻂ ﮐﺎرآﮔﺎﻫﺎن، ﻧﺰد ﻗﻀﺎت ﻧﯿﺰ ﺷﺮط اﺳﺖ. ﭘﮋوﻫﺶ ﺣﺎﺿﺮ ازﻧﻈﺮ ﻧﻮع و ﻫﺪف ﮐﺎرﺑﺮدي اﺳﺖ و ازﻟﺤﺎظ ﻣﺎﻫﯿﺖ ﺗﻮﺻﯿﻔﯽ–ﺗﺤﻠﯿﻠﯽ ﺑﺎ ﺗﮑﻨﯿﮏ ﭘﯿﻤﺎﯾﺸﯽ اﺳﺖ. ﺟاﻣﻌﮥ ﻣﻮرد ﻣﻄﺎﻟﻌﻪ ﻗﻀﺎت دادﺳﺮا و دادﮔﺎه ﮐﯿﻔﺮي ﻣﺮﮐﺰ اﺳﺘﺎن ﺧﺮاﺳﺎن ﺟﻨﻮﺑﯽ دادﺳﺘﺎن ﻫﺎ، روﺳﺎي دادﮔﺎه ﻫﺎي ﺷﻬﺮﺳﺘﺎن ﻫﺎي اﺳﺘﺎن، روﺳﺎي ادارات ﭘﻠﯿﺲ آﮔﺎﻫﯽ اﺳﺘﺎن ﺧﺮاﺳﺎن ﺟﻨﻮﺑﯽ و روﺳﺎي ﭘﻠﯿﺲ ﻫﺎي آﮔﺎﻫﯽ ﺷﻬﺮﺳﺘﺎن ﻫﺎي ﺗﺎﺑﻌﻪ ﺑﻪ ﻋﻨﻮان ﺧﺒﺮﮔﺎن ﺗﺤﻘﯿﻖ و ﮐﺎرآﮔﺎﻫﺎن ﻫﺴﺘﻨﺪ و ﺟﻤﻌﯿﺖ ﻣﻮرد ﻣﻄﺎﻟﻌﻪ از ﺳﻪ ﻃﯿﻒ ﻣﺨﺘﻠﻒ )ﻗﻀﺎت دادﺳﺮا-ﻗﻀﺎت دادﮔﺎه-ﺧﺒﺮﮔﺎن ﭘﻠﯿﺲ آﮔﺎﻫﯽ( و ﺑﺼﻮرت ﺗﻤﺎم ﺷﻤﺎر )60 ﻧﻔﺮ( درﻧﻈﺮ ﮔﺮﻓﺘﻪ ﺷﺪه اﺳﺖ. ﺑﻪ ﻣﻨﻈﻮر ﺑﺮرﺳﯽ ﺻﺤﺖ ﻓﺮﺿﯿﮥ اﺻﻠﯽ ﺗﺤﻘﯿﻖ از آزﻣﻮن t ﯾﮏ ﻧﻤﻮﻧﻪ اي اﺳﺘﻔﺎده و ﻣﻼﺣﻈﻪ ﺷﺪ ﮐﻪ ﻣﯿﺎﻧﮕﯿﻦ اﯾﻦ ﻣﺘﻐﯿﺮ 4/237 و اﻧﺤﺮاف ﻣﻌﯿﺎر آن 0/272 ﺷﺪه اﺳﺖ؛ ﺑﻨﺎﺑﺮاﯾﻦ ﻓﺮﺿﯿﮥ اﺻﻠﯽ ﺗﺤﻘﯿﻖ ﻣﻮرد ﺗﺄﯾﯿﺪ ﻗﺮار ﻣﯽ ﮔﯿﺮد و ﻣﯽ ﺗﻮان ﮔﻔﺖ اﻗﺪاﻣﺎت اﻓﺴﺮان ﺗﺤﻘﯿﻖ در ﺗﺼﻤﯿﻤﺎت ﻗﻀﺎﯾﯽ، از اﻋﺘﺒﺎر ﺑﺎﻻﯾﯽ ﺑﺮﺧﻮردار اﺳﺖ؛ ﺑﺪﯾﻦ ﻣﻌﻨﯽ ﮐﻪ ﺗﺤﻘﯿﻘﺎت ﮐﺎرآﮔﺎﻫﺎن ﭘﻠﯿﺲ ﮐﻪ در ﻗﺎﻟﺐ ﺻﻮرت ﺟﻠﺴﺎت وﮔﺰارﺷﺎت ﻣﺨﺘﻠﻒ ﺑﻪ ﻣﺮﺟﻊ ﻗﻀﺎﯾﯽ ارﺳﺎل ﻣﯽ ﺷﻮد، ﻧﺰد ﻗﻀﺎت دادﮔﺎه ودادﺳﺮا از اﻋﺘﺒﺎر ﺑﺎﻻﯾﯽ ﺑﺮﺧﻮردار ﺑﻮده و ﺗﺎﺛﯿﺮ ﻣﺴﺘﻘﯿﻤﯽ ﺑﺮ ﺻﺪور اﺣﮑﺎم ﻗﻀﺎﯾﯽ دارد.

Detectives and investigative officers of the Awareness Police, as a scientific-specialized police, have a more prominent role in dealing with crime and criminals. This issue becomes more apparent when the investigator and the criminal judge issue a verdict based on the reports received by this group of officers; Therefore, in order for the evidence collected by the officers to be valid, in addition to the fact that they must be trusted and trusted by the judicial authority, the evaluation and approval of the measures taken by the detectives to gather evidence is also a condition for judges.
 The present research is applied in terms of type and purpose and in terms of descriptive-analytical nature with survey technique. ﺟThe case under study is the judges of the prosecutor's office and the criminal court of the capital of South Khorasan province. The study population is from three different spectrums (judges of the court-judges of the court-experts of the intelligence police) and is considered as a whole (60 people). In order to verify the main hypothesis of the research, a sample t-test was used and it was observed that the mean of this variable is 4.237 and its standard deviation is 0.272; Therefore, the main hypothesis of the investigation is confirmed and it can be said that the actions of the investigating officers in judicial decisions have a high validity; This means that the investigations of police detectives, which are sent to the judiciary in the form of various minutes and reports, have a high credibility with the judges of the court and the prosecutor's office and have a direct impact on the issuance of judicial verdicts.
